(MyFoxBoston.com) – The illegal immigrant who was drunk driving when he hit and dragged a Milford man to his death has been ruled incompetent to stand trial.
Judge Janet Kinton-Walker says Nicolas Guaman's "unique cultural background" and language barrier means that he doesn't understand the court process. The court also said that he lacks the ability to consult with his attorney properly.
The judge ordered Guaman's attorney to find an interpreter and educate him on the court process.

Pablo Guaman, was charged in late January with letting Nicolas Dutan Guaman, who did not have a license, drive the pickup.
David Dutan Guaman was charged with armed assault in a dwelling, assault and battery with a (kitchen) knife, and failing to appear for two warrants for driving charges, including driving without a license, police said. Yeah his unique cultural background, let’s see that would be illegal alien, law breaking scum! He sure understood how to get drunk, get behind the wheel of a car and kill someone, so I’m sure he’ll understand prison! This lawyer should be locked up for seriously putting on this feeble, insulting defense. Oh, they come from a third world country so they don’t understand right and wrong. Put both of them in prison.
They should give him a snicker bar after lunch everyday and put toys in his cell to show we care...Allow the tax paid interpreter to show him how to play with his toys and teach him about our laws with approved legal coloring books. Only if we can win his approval and understanding, then he might be released back into society to be productive once again.
Okay, but here is my take: They should give him lots of Snickers bars made with Ex-LAx and many wonderful toys that he can play in the tub with while they are plugged into 220V. And you know what if they follow my plan he won’t need any stinkin coloring books and will end being more productive than he ever was before!

I do think the judge is trying to make the case “appeal resistant”, because it is actually pretty common for people to not be able to defend themselves due to linguistic problems or unfamiliarity with the court system.
While he might have been in court several times before, it was likely on petty issues. But with a serious felony, courts do try to make sure that defendants can defend themselves if they are able.
The biggest examples of this are on the Indian reservations, for example the Navajo res in Arizona, where a court appointed translator may use the word “untranslatable” so many times in a row that entire sentences and complex ideas are lost. The judge usually stops things and asked the witness to rephrase, which may or may not help.
For a long time in Alaska, until perhaps the 1950s, they were still getting confused defendants, who didn’t understand why, if they were guilty, they were being given free room and board all winter as punishment. It sounded like a reward.
