Enemy Combatants in Boston, Was there a FISA order issued for Tamerlan Tsarnaev?
WSJ ^ | 4-21-13 | Opinion

Posted on 04/22/2013 4:20:50 AM PDT by quimby

A row has broken out over whether the Obama Administration is violating the legal due process of Boston terror suspect Dzhokhar Tsarnaev by not reading him his Miranda rights before questioning. The more relevant question for the safety of the U.S. homeland is why the Administration has declined to designate him as a terrorist enemy combatant.

With Dzhokhar wounded and in custody and his brother Tamerlan dead, the focus is shifting to how the brothers became radicalized and whether they had links to foreign or domestic terror networks. It's becoming clearer by the day that elder brother Tamerlan had become increasingly religious and that his motive last week was Islamic jihad against America.

U.S. officials say he spent months overseas in 2012, including time in Chechnya. When he returned, media reports say the FBI questioned him after a warning from a foreign intelligence service (presumably Russia's). Yet the FBI appears not to have kept an eye on him, though media reports now say that within a month of returning from Russia he was posting jihadist videos on websites.

The FBI has some explaining to do, and more than merely claiming that it can't track everyone who pops up on a foreign intelligence list. One question is whether anyone in government requested that the federal FISA court issue a warrant so Tamerlan could have his Web postings or phone calls surveilled electronically. This doesn't mean G-men in a car following him 24-7. It means putting him into a National Security Agency program so that pro-jihad postings would be noticed.

People in power should be asking for any and all documentation relating to the policies and procedures for tracking, dealing with and investigating Muslims. Specifically any which limit it in ANY WAY.

No one should expect any competence from the Justice Department under Holder and Obama.

Even if Obama were not Muslim and he just appointed Holder because he was a black friend, there should still not be any thoughts of competence.

Obama sent a missile over to kill an American Jihadist, but he will not call this Muslim in Boston and enemy combatant.
That really does not make much sense does it?

We were warned about this man from the Russians, and yet we made him a Naturalised citizen.
What does that tell you?

While Obama is fighting to take away our guns he is making citizens of jihadists.

and he chose 9/11 as the date of his citizenship.

Nothing of interest here ... /sarcasm

And...

How many warrants were issued for the block-by-block, house-to-house, room-to-room search by heavily armed SWAT officers??

Rigt,

I like the way officials are handing our security over to US.

They can't (WON'T) enforce immigration laws and follow up on information about dangerous people ... but WE are supposed to say something if we SEE something?

Really? Is’t it a little late at that point?

If the Fed can tax me to the point of radical mastectomy, then they can secure the borders properly... it IS what I am being robbed for isn't it?

The explanation is simple.

The POTUS is a Muslim, and his appointments to DOJ and Homeland “Security” are too.

He will not do ANYTHING to hurt the Ummah. He will obfuscate, object, confuse, and deny all efforts to secure the nation. He will assure that the enemy will win.

Lock and load, boys and girls.

The FBI has its hands tied by Democrats and their ilk. The blood is on Soetoro, Incompetano, and Holders hands. Liberalism is a mental disease and the ‘Rat party is a criminal enterprise.

When you listen to this guy’s rhetoric it’s hard to tell if it is more radical leftist from a university or radical Islamic from a mosque — they have so much in common.

The "people in power" don't track, deal with, or investigate muslims.

The FBI has some explaining to do...

Well, I suppose, but let's keep our eyes on the prize.

Given the magnitude of this event, they will want a scapegoat. The relevant bureaucracies' immune systems will already be working full time to find and to "give up" for Congressional and media crucifixion "those responsible".

It is probable that "those responsible" will include a number of patriots. This will represent a golden opportunity for Obama to purify his administration even further.

THOSE RESPONSIBLE ARE OBAMA, JARRETT, HOLDER, AND NAPOLITANO. PERIOD.

I have no interest in "explanations" that don't involve the House Judiciary Committee.

Let the FBI explain this...

Once FBI had the pictures of the terrorists, you’ll remember they weren’t made public for 24hours, as TV reporters were saying they had seen the pictures. (I was questioning this back then.) Why not pull the drivers license picture of everyone the FBI has interviewed within 90 miles in the last ten years? Put everyone with dark hair on top of the list. They had thousands of feds/state police. They couldn’t assign ten people to review those pictures, maybe ten seconds each. That’s not hard to do at all...!!!! But, remember they had closed that/those files -is it arrogance? Did they not want to acknowledge the prospect that they may have interviewed one or both of the terrorists -is it CYA?

The people you note are all pawns of a much larger sinister anti USA cabal. Jarret is probably a step or two higher in the cabal.

We're all worried about reading a terrorist his Miranda rights, but nobody is making a peep about an American city being "locked down" (prison term), and the 4th Amd tossed out the window for thousands of American citizens.

A new 6-minute YouTube video by yours truly and Mark P. Ferri, about the loss of freedom in America.

The first thing Napolitano did when she was appointed to Homeland Security was issue a report that basically stated that the enemies of America are Americans-single issue group like pro-lifers and 2nd Amendment supporters, and right wing groups. Obama’s challenge is defeating domestic political opposition. “Getting revenge” and “punishing his enemies” who “cling to their guns and religion”.

Regardless of what is going on, they will always need a warrant to get in at my house. I am sure all those idiots just said “sure”, in which case they didn’t need a warrant.

Obama's entire agenda---and his admin appointments--- advance Islamic terror, supports The Muslim Brotherhood with cash and weapons. Obama's obsessed with his "legacy"...and fears it is threatened by the Boston bombings.

He should be fearful---his is being outed bigtime. Ohaha's self-serving sap-happy speech after the surviving bomber was apprehended, cautioned terror-stricken Americans not to "rush to judgement" that diversity was "our strength" (or some sappy nonsense like that).

IOW...the legacy freak intimated....hey, I gotta get control of the Congress---"diversity" will get Dems reelected. So, you stupid Americans, just relax, lay back, and enjoy it as the terrorists come to kill you.

THERE'S MORE---Even if Americans were to accept the politicians' preposterous premise that there is zero national security threats by giving "the undocumented" all the benefits of US citizenship, we MUST keep in mind that sap-happy Obama immigration policies conferred on the viscious Boston bombers the very same benefits.

Tamerlan Tsarnaev, the 26-year-old Chechen terrorist killed Friday morning in a wild shootout with Boston police, was a legal US resident. He could have been sent back to his homelabd after a 2009 domestic violence conviction. BUT thanks to Obama’s sucking up to ethnic solidarity terrorism, the prez sap-happily decreed that "deportations" are limited only to for foreigners who committed “serious crimes” ao obama allowed the bomber to stay and do his dirty work.

The second bro/bomberDzhokhar Tsarnaev--now in a Boston hospital---gained US citizenship in 2012 after being granted "asylum" in 2002.

NOTE THAT Foreigners who come here claiming "asylum" suck off American taxpayers bigtime---they are able to collect generous monthly checks from SS without having put a dime into it.

The FBI may have dropped the ball on this one, considering that he was reported by another country as someone to watch, but I will say this on behalf of the FBI and the other defenders of the country. It is easy to look back now and see the jihad videos and posting by Tsarnaev and say, holy cow, that guy should have been locked up a long time ago! But the sad and disturbing fact is that there are THOUSANDS of Tsarnaevs posting jihad videos, hate speeches, death to USA etc on Facebook and YouTube and countless other places. A lot of them are technically Americans, or at least legally here. Just posting death to America is not yet a crime, and you know what would happen if we were to just “round up” every Muslim hate poster; the screams of profiling and lawsuits would block out the sun. Unless we are willing to get really serious and go after these people, there is little that the FBI can do except to watch as many of them as they can. If we change the rules so that “hate speech” is cause for arrest, what is to prevent Obama and Holder from rounding up all the FR posters?

Agreed, if they went through “the process” as they should, they would be vetted as to their past, their jihad videos etc. There are some countries which should just be no immigration allowed.
