FDA Says Morning-After Pill Must Be Available To Anyone Over 15

The morning-after pill is to be made available over the counter to anyone in the US aged 15 and over, authorities announced on Tuesday.

Days before a court-imposed deadline, the Food and Drug Administration (FDA) lowered the age limit for Plan B and said it that a prescription would no longer be required to buy it. Instead, the pill can sit on drugstore shelves just like condoms, but buyers will have to prove their age at the cash register.

Earlier this month, a federal judge ruled that Plan B should be sold without restriction and gave the FDA 30 days to act. The FDA said its latest decision was independent of the court case.

Scientists, government health agencies and groups including the American Medical Association, the American Congress of Obstetricians and Gynecologists and the American Academy of Pediatrics have recommended unrestricted access to emergency contraceptives for years. The FDA said in a December 2011 memo that "there is adequate and reasonable, well-supported, and science-based evidence that Plan B One-Step is safe and effective and should be approved for nonprescription use for all females of child-bearing potential".

That recommendation, delivered as the campaign for the 2012 presidential election was getting under way, was overruled by the US secretary of health and human services, Kathleen Sebelius.

In a judgment last month, US federal district court judge Edward Korman described the restriction as "a strong showing of bad faith and improper political influence". He said the decision was "arbitrary, capricious, and unreasonable", and ruled Plan B should be made available without age restrictions.

"A strong showing of bad faith and improper political influence" is the way all liberals view conservative positions.

I suspect that the decision to make the morning-after pill available without a prescription, has more to do with liberals circumventing the pharmacist's ability to deny prescription medication than it has to do with the convenience, availability to acquire the pill at a moment's notice so that no pregnancy can develop.

Several years ago a morning-after prescription pill caused a furor when pharmacists in certain states having the right, power to deny dispensing prescription medication for any reason, refused to dispense the morning after pill based on their religious views on birth control, which of course had the liberals going stark, raving mad. But, if no prescription is required the pharmacists have no mechanism in which to refuse the non-prescription morning-after pill from being displayed, sold along side condoms.

From a medical standpoint, just how safe is the morning after pill?

I'm a doctor, and I know that NO drug is without side effects, some deadly.

Here they've randomly chosen 15 years old as the cut off for making an "informed" decision.

But I'd never sell a 15 year old 10 boxes of Nyquil.Or even a bottle of cooking sherry.

Even though I guess it's "legal" for them to buy.

Little by little (thanks to liberals) this country is slipping away and not a word from scumbag republicans. No depraved act is to much for the liberals. Many obama voters will go for this. Don’t teach your children morality, just give them a pill. Remember, obama said his daughters shouldn’t have to suffer from an accident.

It seems like the Second Coming is right around the corner. Lord, PLEASE come soon!

It’s purely political. Unconstitutional federal agencies that serve no purpose other than advocating even bigger government and socialist politics like the FDA, the EPA, education dept, labor dept, energy dept, commerce dept, USDA, HUD, and hundreds of federal welfare programs etc, etc, etc, should be defunded, disbanded, dissolved and permanently shuttered.

With or without this change, they can already do that. "Plan B" is already over-the-counter (though kept behind the counter, like Sudafed) - nothing is stopping pimps from buying it now, and this new rule changes nothing in that regard.

Conversely, where is the constitutional authority for the opposite: FDA says Morning-After Pill Must Be Prescription-Only and Available Only To Anyone Over 18 (or 21)?

It doesn't surprise me that a British journal would overlook that the states have never delegated to the federal government via the Constitution the specific power to regulate intrastate commerce, including health issues. But here are several excerpts from Supreme Court opinions which clarify such limits on the federal government's powers. Note that these excerpts have been posted in related threads.
"State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress (emphases added)." --Gibbons v. Ogden, 1824.

"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." --Justice John Marshall, Gibbons v. Ogden, 1824.

"Inspection laws, quarantine laws, health laws of every description, as well as laws for regulating the internal commerce of a state (emphasis added) and those which respect turnpike roads, ferries, &c., are component parts of this mass." --Justice Barbour, New York v. Miln, 1837.

“Direct control of medical practice in the states is obviously beyond the power of Congress.” –Linder v. United States, 1925.

Having engaged in good-time sex, willingly, is not an "accident" by any stretch of the imagination.....WHATSOEVER.

Encouraging un-married women to engage in Flukeing for the fun of it, with no responsiblity whatsoever for the outcome, is what is taught in Liberal-run schools today. We wonder what makes kids go over the edge, shooting their classmates, etc., when we teach them that it's ALWAYS someone else's fault for mis-behavior/deviance, and they are ALWAYS just "victims".

Until America realizes that we HAD a Christian, self-resptecting, dignified, moral NUCLEAR FAMILY with Breadwinner+child-rearer WHICH RESULTED IN PROSPERITY AND PRIDE THAT WAS THE ENVY OF THE WORLD, because Americans had VALUES and self-reliance, not parasitic dependency on the backs of others, we will go further into the Abyss.

EVERY pregnancy, whether terminated by abortion or brought to birth, should REQUIRE DNA-testing for determination of the paternal father, who will bear the responsibility for ALL costs associated with the pregnancy, period. No more reliance on Welfare, EBT's, WIC, Food Stamps, etc., when un-limited fatherless children and un-limited abortions are billed to Taxpayers, while the parasites "let the good times roll!"

And those under fifteen who can get pregnant are not allowed to get the pill. Case a couple of weeks ago where the mother, 14, killed her baby and the husband, 15, no where around. Child was in care of grandmother. The pill can be arguable in both directions, pro/con.

Exactly, when a radical is elected to office, the radicals come out of the woodwork.

It is the political equivalent of shock and awe. Before the dust settles on one ludicrous proposal they hit you with one or two more.

While you are putting out one fire, you are not paying as much attention to the previous proposal(s).
