A judge would allow the DOJ/Executive Branch to gain access to phone records of congressmen in the capital building who just happen to be in the cloak room? I'm not a lawyer, but from what has been discussed on this matter so far makes it appear that the Attorney General can approve the subpoena for the phone records - the didn't have to go to a judge for that.
