OKLAHOMA CITY -
Police say an elderly man held a 28-year-old burglary suspect at gunpoint when the man allegedly tried to break into his house early Thursday morning.
The man was awakened around 4:30 a.m. when he heard noise at his back door in the 5000 block of S. Bypass Terrace. When he went to investigate, he said he saw Anthony Cabralalez attempting to break in to the house.
The victim told Cabralalez to stop and go away, but the suspect kept trying to get inside the house. The victim said he even tried to get in through a small window.
The victim called police then grabbed a rifle. He pointed it through a window and told Cabralalez to sit down and wait for officers to arrive. The victim said Cabralalez refused, and continued trying to break through the door.
The homeowner fired three warning shots into the air, and that's when Cabralalez finally sat down. When police arrived, they found a broken blade from a knife stuck in the back door, where it appeared Cabralalez had tried to pry it open. Police arrested Cabralalez and booked him into the Oklahoma County jail for first-degree burglary.
The victim got the best possible result. He must have felt no immediate bodily threat.
Under those conditions, I’d consider a warning shot, but ONLY if I have a high capacity mag :)
Surely you jest? I think all warning shots should be fired after the perp is disabled with fatal gunshots. It would warn co-conspirators of the gravity of invading a house at night.
Warning shots are a critical waste of lead, and ability to defend.
Texans don’t do warning shots. We have too many criminals in our prisons and they are very expensive.
Nope, the scumbag will get out shortly and do it again. The next homeowner may not have a gun.

Would it have been better for the homeowner to go through the trama of a justifiable killing?
Yes - a righteous shoot, is a righteous shoot. I crossed that line when I acquired my firearm(s) and ammunition.

It is better to be judged by twelve, than carried by six.
The rule is “never fire warning shots”, as it almost always proves the threat isn’t imminent.
A good whack over the head may have made him stop, BUT the victim is 87 and shouldn’t risk getting that close.
Yes, and lots of people mention that the criminal will now victimize others.
It is not an easy decision. I will not criticize the 87 year old for his.
If I am not in fear for my life, I won’t kill anyone who isn’t a serious threat to me.
