Here in Colorado we have a statute prohibiting such a dismissal:
§ 24-34-402.5. Unlawful prohibition of legal activities as a condition of employment
(1) It shall be a discriminatory or unfair employment practice for an employer to terminate the employment of any employee due to that employee’s engaging in any lawful activity off the premises of the employer during nonworking hours unless such a restriction:
Many States have similar laws. Go show THAT to those attorney’s.
This is why knowledgeable HR departments steer clear of stating reasons such as what that stupid letter did.
Where is Dexter when you need him?
The school has no ability to "tackle him". He ignores restraining orders and the criminal justice system does not do anything effective about it. What do you expect them to do about him, hire a hit man?
The only thing the school has the ability to change is her employment status with them.
