John Spooner of Milwaukee charged with homicide in Darius Simmons' death

The twice-delayed trial of 76-year-old John H. Spooner, accused of fatally shooting his 13-year-old neighbor, got off to a slow start Monday, as cases backlogged because of last week's courthouse fire took up most of the morning.

Jury selection is now expected to get underway at 1 p.m. Milwaukee County Circuit Judge Jeffrey Wagner requested a pool of 50 potential jurors, a larger-than-usual number due to the publicity Spooner's case has gained in the past year.

Spooner faces a charge of first-degree intentional homicide after allegedly killing Darius Simmons in front of his mother.

Spooner suspected Simmons of stealing guns from his home and confronted the teen about 10 a.m. May 31, 2012, according to a criminal complaint. Then, as the boy's mother watched, Spooner shot Simmons in the chest with a handgun from five feet away.

I can't find anywhere in the article whether Spooner was right or wrong in accusing Simmons.

Based on the events as told in the article, he was definitely wrong to shoot the kid, though.

To compare this event to the Zimmerman/Martin event however is a tremendous reach.

Jonathan Safran, a private attorney representing Simmons' family, said he sees a clear "issue of profiling" and a "race component to (the case)" but that clear differences distinguish this trial from the Zimmerman trial, including the lack of a stand-your-ground law in Wisconsin and the lack of a self-defense claim on Spooner's part.

They're the same..........only different.

You mean the young Simmons went to confront Spooner and was perched on top of Spooner, beating the carp out of him, when Spooner shot Simmons? That is how it compares?

This is the problem.

Based on the framing of the Zimmerman case by the media, you would have also thought Zimmerman's conviction was a slam dunk. The best rule these days is to believe the opposite of whatever a media outlet says...

If I remember this correctly, the old man had been the victim of several break-ins. The kid kinda taunted the guy and got killed for it - asked him if he found his stuff or some such. Not self-defense, no way in the right. He thought the kids older brother had taken his stuff, and was upset that the neighbor kid taunted him about the missing stuff.

Is that this case?

In a world of tribal justice, the two acts are equivalent.A white or designated white man shot a black person. It does not matter why the person was shot, only that the black person was shot. That requires Revenge from the tribe.
