The big message here is to the Supreme Court of the United States, who in 2005, “abolished capital punishment for juvenile offenders, ruling 5 to 4 that it is unconstitutional to sentence anyone to death for a crime he or she committed while younger than 18.”
Which shows that the treacherous vote of Anthony Kennedy, once again the deciding vote in this case, really matters.
Always with an eye to international opinion, in writing the opinion for the majority, he wrote: “Our determination finds confirmation in the stark reality that the United States is the only country in the world that continues to give official sanction to the juvenile death penalty.”
This also shows Kennedy’s ignorance, in that juveniles are still executed in China, Democratic Republic of Congo, Iran, Pakistan, Yemen, Nigeria, and Saudi Arabia. Also many other nations *effectively* execute juveniles by starvation and Islam.
Kennedy was likely thinking of the UN Convention on the Rights of the Child, which the US (Madeleine Albright, on behalf of Bill Clinton) signed, but was not ratified by the US senate. It forbade execution of those under 18 when they committed their crime, which has not stopped those other nations from executing juveniles, with their legal system or not.
