I am not sure how being mentally allows you to kill someone and people think you shouldn’t be punished.

What’s the problem?
All killers are mentally ill.

There are the mentally ill and then there are the mentally incompetent. Not that the difference matters anything at all to their victims.

Ditto. The therapeutic treatment of evil is far more evil than the act of itself.

Newman's grandson had told Lackey that his grandfather had a vault filled with gold bars, according to court documents. They executed the wrong person.

There should be a new verdict:
Guilty BY reason of Gross Insanity with no hope for rehabilitation what so ever!
James Holmes would qualify for this verdict

Sounds like he murdered a Christian.
Hussein probably wanted to give him a medal.

Lackey, formerly of Huntsville, was convicted in 2008 in the 2005 Halloween slaying of 80-year-old Charlie Newman (WW II Vet). He shot and stabbed Newman to death during a robbery at Newmans home on Hine Street in Athens. Let's add this up shall we. We are supposed to oppose the death penalty because Lackey "shot and stabbed a WWII Vet during a robbery on Halloween". How does that make sense?

Let's face it, 90% of the Southern populace (Black or White) are borderline retarded, why else would they start voting Republican ?? not that the so-called Democrats are the party of the working class anymore but sleazy wedge issue (aka racism and religious intolerance) have somehow changed what was the bastion of the Democratic party into a bunch of Morlocks who vote for Republicans even though it's against their own self interests.
Example: Texas, the current Neanderthal Governor makes even Dub-ya seem like a Mensa star.
Texas, history will judge you, and I don't think it will be kind, except for a few jewels of creativity like Austin
your state would have been better left as part of Mexico.

The point is that if you are certifiably mentally ill, you are not in your right mind. Severely mentally ill people are in a mental state where they cannot understand whether what they are doing is either right and wrong. Its not that their actions (murder in this case) are justifiable, its that they are culpable for them. This is why I always cringe when people say things like "these terrorist bombers are mad". No they are not mad. That is the frightening thing. If they were mad, I could understand and even excuse their actions. But they arent. They are completely lucid. Not mad but evil.
Of course, what the shrinks never talk about is why incidences of "paranoid schizophrenia", "multiple personality disorders" and so on are so rare in countries where having them is not a legal defence against murder :) IOW, people are playing the system...claiming insanity when they arent in order to avoid punishment.

If the person does not need 24-7 care and attention, like a leash, with an attendant they should be help culpable
