Yes...I heard judge Napolitano discussing this yesterday on Fox, he said basically the same thing.

He said the prosecution has to prove that the defendant intended to hurt the United States.

I believe he did but I guess the judge thought otherwise.

Intent to injure was the issue. First, the had to prove injury and then they had to prove it aided the enemy, and then they had to prove intent to aid the enemy.

I wonder why they even brought the charge.

That's a good question.

I never heard anyone say they thought he'd be convicted on that charge because it was a high threshold. Plus from the git go there was all the claims he was just a whistle blower.

Hopefully this judge won't give minimum sentences on the charges and have them run concurrently.
