EU pushes through Unified Patent Court

Brussels has paved the way for a specialized European patent court to solve disputes in one instance and avoid multiple litigation cases in up to 28 different national courts.

The European Commission yesterday (29 July) announced the legal framework for Europe-wide patent protection by updating EU rules on the jurisdiction of courts and recognition of judgments, the so-called Brussels I Regulation.

The changes are intended to make it easier for companies and inventors to protect their patents. The Unified Patent Court will have specialized jurisdiction in patent disputes, with an aim to cut legal costs and speed up decisions in patent infringement cases. …

Patent law has been generally harmonized throughout the EU (indeed, by way of the PCT, globally) for decades. What remains are some slight differences in national (non-EPC) granting/infringement procedures. Hardly of benefit for the vast majority of patentees.

And this Unified Patent Court only concerns European Patents, not national patents, which anyone can still opt for.

Seems to create “European patents” too. Anything to push through that “ever closer union” that only the elites want.

No one is protesting against the European patent system (which was initiated in 1973, so what do you mean “it creates European Patents” - of course it does, that’s the whole point). It is welcome by all who use it.

This is not a good example for your “elites pushing union” rhetoric.

OTC, it is a prime example of same.

As for protests against the EU per se, the media tends to ignore them. Does not mean they do not occur.

Nice strawman there. Your link has nothing at all to do with the European patent system.

OTC? By context, I’ll take a guess that it means ‘on the contrary’. Well, no, actually. It is no prime example of the overbearing actions typical of the EU. QTTC, it is a case of the concerned circles wanting such. So the ‘EU pushes through’ (i.e. ‘forced from above’) statement of the headline is quite amiss.

No, I am just discerning between something that is beneficial and the bad stuff, based on experience and facts.

OTOH, you seem to be incapable of doing so. Or you just don't want to. Whatever. Your championing of "the goals of the EU people" is worth a laugh, at least. As if you had any clue.

Experience and facts? Facts are that this is being pushed through by the elites, taking it out of the hands of the (formerly) sovereign individual member states. Not only is that centralization, it's imperialism. Please demonstrate how any of this can be reconciled with US conservatism.

This site does deal with US conservatism primarily; it’s a standing topic. Included among the related topics, FWICS, is any philosophy that holds enmity to the USA’s conservatism and potentially endangers it.

The European Union is a project of the elites (not even the NY Times can deny that), based (as Vladimir Bukovsky has described) on the USSR. Describing someone stating facts as being “pathological” is an Alinskyite tactic that liberals will use. I don’t mind being told I am “wrong,” but if it is merely someone’s opinion without describing how I might be so, then that is all I can treat it as, and so be dismissive about it.
