I am not going to comment on the case as a whole, but the following line troubles me:

Clary [the defendant] is also charged with tampering with evidence to cover up the crime.

As it stands now, she’ll have to testify - absent a SCOTUS ruling about civil unions being covered by spousal privilege or that the Kentucky amendment is unconstitutional ...
