Section 3 of 776.013 of the Florida statutes reads, "A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony."
Section 3 was added into the law in 2005. Since then, according to statistics compiled by Eyewitness News, there have been 31 cases in central Florida in which this immunity clause has come into play, and in a majority of those cases, the defendant has avoided prison time.
Of the 31 cases compiled by Eyewitness News, nine suspects have been black, 18 white, three Hispanic, and one of Asian descent.
Convictions have not trended along racial lines. According to 9 Investigates' numbers, two cases are still pending in the courts. However, seven white defendants have either pleaded guilty or been convicted, one black defendant pleaded to lesser charges and a Hispanic defendant was found guilty.
"It seems in the cases that did use self-defense that race didn't have anything to do with it, that gender didn't have anything to do with it," said University of Central Florida Criminal Justice professor Dr. Kareem Jordan. "It really did boil down to, for the most part, that this person really did feel their life was in danger."

Stand Your Ground laws remind me of the famous Sheriff Buford Pusser, he is the one whose story was told in the movie “Walking Tall”. Smith & Wesson built a Commerative .357 magnum honoring his memory.
Its important to point out that 'Stand Your Ground' laws are NOT confined to the use of guns, they apply to any and all types of self defense.

These are two false arguments. To start with, a person who defends themselves is not a “suspect”, and “avoiding” prison time is legal, “evading” prison time would not be legal. People avoid prison time all the time, by following the law.
Second, “discretion” does not exist when someone is threatening you with assault, mayhem or murder. Your only choice is to submit or fight back.
And, I might add that the jackasses who suggest that a woman being raped, “lay back and enjoy it”, instead of resisting, are both morally and tactically failures, because *any* resistance to aggression radically increases the “degree of difficulty” of aggression, and slashes the likelihood of the aggression having the preferred outcome for the aggressor.

Note “Jordan’s” implication that the average person lacks the discretion to judge when his/her own life is in danger, but someone else not in harm’s way or even present (the police perhaps?) would know better.
Same here in MA. If perhaps he is not armed but is clearly strung out and is a raving psychopath who is physically attacking me or a loved in in my home...I can guarantee that he WILL be armed by the time the local constabulary comes to collect his perforated body. I believe I'll have several minutes if not longer to get things in order.

Link not downloading for me. Not sure of the station location but the copy posted and the source attritbuted is not using the race issue. Plus at this posting no Floridians are responding. But if it was a Florida station and it was playing Trayvon advocate it should be picketed.
Fact is that NBC station which did the false reports should be getting harrassed every which way untill they’re outof business.
Been here all my life as have my people, It’s home and I love it, but it’s politics suck.

I know how you feel, friend. If I'd been born in California, I might not have been able to make myself leave. I was there from 19922002, and missed it acutely the first few years after leaving.
