CHAMBERSBURG, Pa. An illegal immigrant who killed two people in a car crash while his deportation was reportedly on hold is headed to state prison for eight years.
As part of a plea agreement, Agustin Macias-Marquez, 28, formerly of Waynesboro, Pa., admitted he consumed enough beer to reach .14 blood-alcohol content, drove a car without a license, ran a stop sign and caused a two-vehicle accident that claimed two lives.
The broadside collision occurred Dec. 31, 2012, in Chambersburg.
The families of victims Heather Coble and Madison J. Perry listened as Franklin County (Pa.) Court of Common Pleas Judge Carol Van Horn sentenced the defendant Wednesday.
U.S. Immigration and Customs Enforcement has a detainer for Macias-Marquez and will likely deport him when he is scheduled to be released from prison, according to statements from the judge and attorneys.
Court-appointed defense attorney Chris Reibsome told the judge about a discussion he had with Macias-Marquez about an earlier effort to deport him.
Macias-Marquez said he was in the process of being deported after a 2011 driving-under-the-influence case, according to Reibsome. But Macias-Marquez claimed the Franklin County District Attorneys Office put a hold on that deportation because it wanted him to testify in court about a homicide he witnessed on Oct. 22, 2012.
Reibsome cautioned he did not verify the accuracy of his clients statements.
Franklin County District Attorney Matt Fogal did not respond to a request for comment before deadline Wednesday. It was unclear which country held the ICE detainer.
Cobles family showed a reporter pictures of the Saturn car in which Coble and Perry were passengers. It was being driven by Nicholas Fortenberry at the intersection of McKinley Street and Cleveland Avenue in Chambersburg when the collision occurred.

While on jury duty the week of 12/11/06, one of my fellow jurors told me that her nephew was killed a year earlier by two illegals DRIVING their truck with FAULTY BRAKES to the BRAKE SHOP to be repaired when surprise, surprise — the BRAKES FAILED AND THEY KILLED HER NEPHEW. I guess these MORONS thought they were back in Mexico where in addition to driving DRUNK — they and their idiot friends do crap like that all the time. Can you say “Tijuana Taxi?” Can you say “TOW TRUCK?”
The driver got 4 years in prison and will be deported when he gets out.
Gotta wonder how long it will take him to sneak back in and kill someone else?
Estimates indicate they are killing around 25 American citizens each day, either with vehicles or via other criminal activity.
I cant wait until the interstates start filling up with Mexican truckers on tight deadlines and I do mean DEADlines hurtling at carloads of unsuspecting native-born American citizens all 387 of us.
