The difference is not just one of location. A fetus which is not yet viable relies upon the mother's body to infuse oxygen and nutrients into its blood, while a birthed baby does not. The strongest pro-choice argument is that a woman should not be forced to support an unwanted parasite; a policy consistent with that argument would specify that women who do not wish to be pregnant would have the right to have premature labor induced, provided that a pro-life group was allowed to make whatever efforts they could to support the premature infant to until it was medically stabilized and could be adopted.
But in any case, the incrementalists aren't even doing what you suggest. They are in fact codifying "legal" permission to kill 100% of the children, as long as it is done on time, and by their rules.

Perhaps you should read the Amendment again. Its particular clauses make a clear distinction between the privileges and immunities of citizens and the rights to life, liberty, and property of all PERSONS.
All citizens are persons, but not all persons are citizens.
In any case, the equal protection of the right to life of all PERSONS is required in every state jurisdiction.

If the legislation does not provide the equal protection for every person that the Constitution requires, it is immoral and unconstitutional, and therefore illegal. It's simple.

And yes, we do not agree that taking the life of a child is ok pending circumstances of rape....on that I don’t agree. I give God great credit for having overcome and healed woman who have had that experience.. and most of all fully loving the children they bore.
To use rape as a reason to take the childs life is way underestimating the love and power of God and limiting His greatness to mans ideals..not His.
