According to a district judge, strippers need to receive the same wages and labor protection as any other full-time employee. And that's good news for workers everywhere.
What do strip clubs have to do with labor law? Well, Judge Paul A. Engelmayer of the Southern District ruled this week in a class action suit that women working at a Rick's Cabaret in Manhattan had been unfairly denied wage and labor protections due to the club misclassifying them as independent contractors and not regular employees.
In his ruling, Engelmayer wrote that, because the club gave strict guidelines to its dancers – including controlling their attire, and lack thereof – and made them the business's main attraction, "the Court comfortably concludes as a matter of economic reality that the dancers at Rick's NY were employees, not independent contractors." The ruling means that the dancers will need to be paid the minimum wage.

I work as an “independent contractor” frequently, and often the contract I sign has all sorts of rules and riders, sometimes dress code. So I can sue to be a full-time employee?
And a strippers shift is 8 hours?

You might. The law applies a substance over form analysis to determine independent contractor versus employee. There is a multifactor test, but it mostly comes down to the degree of control the boss has.
Not if you have multiple clients, do not rely on one to provide a workplace at all times, and do not take direct direction for your work. That’s the difference here. The dancers really are employees but the clubs don’t treat them as such.
That’s because that they don’t report their earnings. Most strippers earn 5 to 20 times what they claim on their taxes. Any decent looking women will make $1,500 to $5,000 a week and $200 or $300.

I knew a couple students back in the 70’s who paid their way through college as strippers, instead of taking out student loans. That’s a lot of bumping and grinding.

I do have multiple clients and don’t have one place to work.
I suspect you are in a similar position to me ,, I too am a “independant contractor” but I am not as I must wear a uniform , follow their schedule and must comply with a non-compete clause in my contract ... If I’m ever fired (or just taken off the schedule) they will find out in short order that I’m an employee ... I have an IRS finding that I am filed away in my office... I’m barely making enough as it is ,, 99 weeks ,,, especially if gas increases in cost ,, will be a paid vacation with the same pay and will allow me to make good money in “side” jobs.
I can’t believe anyone would pay them so little; better include some pics as proof....
