Burglar caught breaking into Kent farm office shot by owner [Washington state]

KENT, Wash. -- A burglar caught rummaging through an office at Kent's Frager Farm is dead after being shot by the business owner, police said.

The farm's owner went to his office in 25000 block of Frager Rd. S. around 1:30 a.m. after being alerted somehow that it was being burglarized, said Sgt. Cindi West with the King County Sheriff's office. The man arrived to find two young men in his office.

Deputies are still investigating exactly what happened next but eventually a fight ensued, the owner pulled out a gun and fatally shot one of the burglars. The second burglar stayed at the scene until deputies arrived.

West said investigators aren't ready yet to officially call it self-defense.

"It's too early to tell," West said. "We'll do our investigation, send it to the prosecutor and they'll make the ultimate decision whether this was a self-defense case or not."

The business owner was not hurt.

If we didn’t have guns, that poor young burglar wouldn’t have gotten shot. It works that way (for the most part) in England. They have this respectful agreement where the burglars take what they want, and the owners sit back and watch.

Not sure it was self-defense?

At one time common sense ruled. Defending your property, your livelihood was perfectly acceptable. Now only your physical life is allowed. One day, that will be “too cruel” too.

Odd? “...the owner pulled out a gun and fatally shot one of the burglars.” The print article in the Seattle Times said that the owner used a shotgun. I guess whatever happened, I can’t believe the media.

Washington state has one of the most liberal laws on the use of force by private citizens. If the burglars were committing a felony and the business owner was attempting to arrest them, he is in the clear.

In fact, the law on the use of deadly force specificicallt states that private citizens have broader authority in the use of deadly force than eve law enforcement officers.

You can look it up if you want.

Washington State has an article in the state constitution that guarantees a person the right to bear arms in defense of self or others.

Pretty hard to confuse that one.

From Seattle Times article:

Under state law, a person can use reasonable force to prevent or attempt to prevent injury or “malicious interference” with property in the person’s possession. Force can be used to detain someone who unlawfully enters a building.

Homicide is considered justifiable if the person using deadly force is lawfully defending himself or another person from someone who is committing a felony, or someone who presents an imminent danger, according to state law.

One could make a reasonable argument that the Washington law on the use of deadly force is equal to or maybe even broader than the law in Texas.

Anybody who shoots a burglar needs to tell the cops right away, “He said he was going to kill me!”
