The Debt Limit, The 14th Amendment, And The GOP
The Market Ticker ^ | 10-03-13 | Karl Denninger

I have wondered for quite some time why Obama, Reid and Pelosi have been screaming so loudly about not prioritizing and "causing" a default. After all, it's not a default if you cannot pay for every program that was appropriated. You're just not keeping your political promises, which may***** off voters but isn't a default. A default is exactly one thing -- the non-payment of coupon or principal when it comes due.

Now I understand the reason -- the 14th Amendment doesn't empower The President to raise the debt ceiling on his own.

No, the 14th Amendment requires him to pay the interest and principal on Treasury Notes, Bills and Bonds before anything else should there be insufficient funds to cover it all.

John Boehner, it's time you and the rest of the Republicans shove this fact right up Obama, Pelosi's and Reid's ass, making clear that (1) you will not raise the debt ceiling and (2) you will impeach that rat bastard if he fails to cover interest and principal as is required by The Constitution.

Please note that the Media and even the Republicans seem to not understand the Constitution! Could that be the problem?

Either way, the President cannot invoke the 14th Amendment to raise the ceiling. No where in there does it clearly empower him to issue an EO to raise the debt ceiling, but rather Congress can.
Here are the sections below:

Section 4.

The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Section 5.

The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

That’s racist!

I was just wondering if there was any circumstance, any usurpation of power the pos in the White Hut could commit, in which the Republicans would finally see what the rest of us have seen so plainly, or at least become aware that their own powers and rights have been usurped, and call whoever they call in to arrest this pos. I can’t believe our “fellow Americans” subjected the country to this. I hope it bites them in the azz hard.

I wish... but you have to understand that the Media has some major control here and they can rally their troops whenever they desire.

There is nothing yet that seems to discourage the Media so I’d guess that we are lost as of now. There is always hope because the Constitution supports us...

The major problem is that the liberal schools no longer teach the Constitution so who is to know if things are going wrong. We seem to be living in a Alinsky world where only those that control the news control the world.

Media support would play a key role in him getting away with it if Hussein just usurped the powers of the House and elected Representatives and imperially ruled?!

Sorry to say that no, there is nothing that this President can do to cause a revolt. That is of course because he is black and the Media and way to many Liberals will excuse him regardless. Really a problem though as we seem to be taken over by the left via “black”male” (realistically)...”

We have a real problem and I’m not sure how it can be resolved.

It is a simple fact that Boehner ignores, that Obama’s Treasury Department can and will ONLY default on paying any immediate U.S. debt obligations BY CHOICE, by CHOOSING to NOT PAY those debt obligations BEFORE ANYTHING ELSE.

THAT WILL NOT BE any fault of Congress not raising the debt ceiling, but merely Obama’s choice to keep spending on other things instead of putting other things on the back burner so that if nothing else the debt obligations are paid.

If the Republicans were smart they would raise the debt limit for three months tomorrow. Obama would lose all his talking points and you would separate the two arguments. There is a reason they stretched this out so the budget and debt limit came due at the same time.
