Judge: Courts can look into Ariz. 'gun walking' case

PHOENIX – A federal judge has rejected arguments by the Department of Justice that she cannot intercede in a congressional bid to investigate how and why the agency first lied about the Operation Fast and Furious “gun walking’’ operation in Arizona.

Judge Amy B. Jackson said federal courts are entitled to determine whether the Obama administration is wrongfully withholding documents from a House panel looking into the now-abandoned practice of letting illegally purchased weapons make their way to Mexico. That practice came to light when “walked’’ guns ended up at the scene where Border Patrol Agent Brian Terry was killed in 2010.

In her ruling this week, Jackson said the fact the dispute may have political elements is legally irrelevant. More significant, Jackson said just because the fight is between two other branches of government does not deprive courts of their role in deciding who is right.

The courts are moving slow on Fast and Furious, but they are moving. This is a blow to Obama and Holder. I hope this judge does the right thing and forces the Justice Department to turn over the documents in question.

Can they also use the same tactic to investigate how ObamaCare was odorifically passed, how the President singlehandedly changed the law AFTER Roberts morphed it from a mandate to buy a service to a “tax”, and the constitutionality of an imperial president re-writing a law at his leisure? This is no longer the ‘law of the land’, it is the law of one man.

Is Holder actually trying to say that a judge has no right to look into what the Just Us Dept is/was doing?

Essentially, yes. I think, boiled down, the argument was, those nasty Republicans in congress are being mean to me, so tell them to stop.

Why piss into the wind when it’s blatantly obvious we no longer are Constitutional Republic (haven’t been for some time)?

Can you, or anyone, point to anything that’s been Constitutionally based? How about jail/prison/fired for those NOT so based (Issa? HELLO)?
