HOLMES' LAWYERS SPAR OVER HIS STATEMENTS TO POLICE

"It's just me," Holmes said, according to documents and testimony.

Officers asked Holmes other questions about weapons and explosives. Roughly two hours would pass before the chaos subsided and detectives would read Holmes his Miranda rights - anything you say can be used against you.

On Tuesday, Holmes' lawyers will argue that delay violated his constitutional rights and that anything he told the arresting officers should be barred from his trial.

Prosecutors will counter that the officers urgently needed to know whether Holmes had an accomplice who could still be shooting and killing people at the Century 16 theater in Aurora. They contend the questions were legal under a public-safety exemption to the Miranda rule.

Holmes is accused of slipping into the suburban Denver theater on July 20, 2012, and opening fire on more than 400 people who were watching a midnight showing of a Batman movie. Twelve were killed and 70 injured.

He pleaded not guilty by reason of insanity to more than 160 counts of murder and attempted murder. His lawyers acknowledge he was the shooter but say he was in the grip of a psychotic episode.

The shooting started around 12:40 a.m. Officers who rushed to the scene testified they found Holmes standing calmly beside his car near a rear exit of the theater. Victims and survivors were still flooding through the doors as police handcuffed and searched him, the officers testified.

"It is just me," Holmes replied once, but another time he said nothing and "smirked," according to the documents and testimony.

Do you have any weapons, the arresting officers asked. Four guns, Holmes replied.

Do you have any explosives, the officers asked. Holmes replied that bombs were rigged at his apartment to explode if anyone went inside.

I had to excerpt it.

But, it was poorly written.

Funny, but I do some corporate training and teach writing in China. A student asked how to explain everything when they can only write a few words. I said figure out how to put your 5 Ws’ and the H in the first two paragraphs. I foolishly said that this is considered a basic journalism rule too. However, this AP story prove that theory incorrect.

No, TexGrill: you are correct. It is the AP writers who are wrong.

Not only can’t many of them write properly, but too many have a leftist anti-American bias, and a few want to expose as many of our intelligence secrets as possible.

There are a handful of good AP writers, esp. on economics, but they are the exception.

I’ve never had a writing class in my life other than English Composition in college. My first regular newspaper job’s instructions consisted of:

*Keep it concise
*Keep it accurate
*Keep it readable

I’ve been following those three simple requests since 1970 and never had to look back.

Wow, that’s exactly what I emphasize whenever I teach business writing.

Besides, I already know AP is a joke. I met a high-level executive from Italy about a month ago and we spoke about the demise of the global media. We agreed to put much of the blame on AP along with editors of media outlets who don’t let their reporters travel anymore. They tell reporters to spend the day at a desk to re-write AP stories that already have a Leftist slant.

When I first got a full-time job with a media outlet, I was excited because I wanted to travel, interview people and write; but I did none of the above. I just edited. Even when I got to write a daily business column, the editor said, “only Google search for research.”
