This article is one of a minority I’ve seen written correctly in many months as the so-called journalists seek headlines and misuse the term ‘Home Invasion’.
Home invasion is violent burglary of a knowingly-occupied home with intent to exact violence upon the occupants for completing the burglary. It is a brazen crime against occupants knowing full-well they are there and the assailants are usually prepared to deal with it (armed).
“Awaking to a burglar” is NOT a ‘home invasion’, and neither does it change ‘castle doctrine.
Any State that differentiated between ‘burglary’ and ‘home invasion’ with asinine definitions to prevent homeowners from responding as they see fit rightly deserve to be excoriated.
