Attorneys for Apple Valley man argue fetus' death was an abortion

When an Apple Valley woman died in March, her 15-week-old fetus, too young to survive outside the womb, died with her.

Margorie Holland's husband, Roger Holland, is charged with murder in the deaths. But with his trial scheduled for Monday, his attorneys are making a novel argument: The death of the fetus was an abortion, not a murder, and the only person whose rights that such an act could have violated -- the mother -- already was dead.

Dakota County prosecutors disagree, arguing the murder charge is appropriate and that the idea Holland can't be charged in the death of the fetus is "patently offensive."

Holland's fate is unlikely to hinge on the distinction.

How about charging practicing medicine without a license. The feds nabbed a prostitute (dominatrix) for that. She was inserting needles into genitals. The penalties can be severe.

I have to agree.

There is no way in this country if a woman has a right to kill a child how can we charge someone else with killing that child.

If it is a child then abortion is murder.
If it isn’t then no one can be charged with killing it.

I don’t like that, but we are allowing the murder of fetus every day and calling it health care.

I think that, even to Leftists, if the child is wanted it cannot be considered an abortion. Now the fly in the ointment occurs if one party wanted the abortion and the other party didn’t. And women’s rights trump men’s right, every time.

And this violates the "equal protection" principle. If it is legal for the mother to kill it, then it cannot be held to be murder if someone else does it.

Don’t go there. The fact that someone can be charged with murder for killing an unborn child is a win for us. It’s a place to start going the other way. If it’s murder when someone else does it, it’s murder when the mother does it.
