After break, argument on constitutional issues begins. First arguments were with the statute.
Six same-sex couples, represented by the national ACLU, the ACLU of New Mexico, the National Center for Lesbian Rights and an Albuquerque law firm, filed the suit against the state of New Mexico and the Santa Fe and Bernalillo County clerks, seeking the freedom to marry.
State law doesnt outright prohibit or allow same-sex marriage, and lawmakers in the Democratically controlled Legislature have failed to resolve the issue. New Mexicos county clerks asked the court to decide whether such unions are legal after a state district judge in Albuquerque ruled earlier this year that it was unconstitutional to refuse to issue marriage licenses to gay couples.
But no decision on the issue may be coming for several weeks. At a Monday teleconference, Laura Schauer Ives, legal director for the state American Civil Liberties Union, told reporters she hopes the court will decide by the end of the year.
Lawsuits filed in at least two state courts by Republican lawmakers opposed to county clerks issuing marriage licenses to same-sex couples will not be part of Wednesdays hearing. However, Elizabeth Gill, a national ACLU lawyer, said at the teleconference that those legislators filed an amicus brief and will get time to present their arguments against marriage equality at the hearing.
Earlier this year, five state district judges ordered clerks in Santa Fe, Bernalillo, Los Alamos, Taos, and Grant counties to issue licenses to same-sex couples. A total of eight counties out of New Mexicos 33 counties are issuing licenses to gay couples.
More than 900 same-sex couples have been issued marriages this year.
Based on the obvious bias of the justices in their questioning and comments, I'm changing my comment:
Outcome is likely most certainly predetermined.
Hearing is now over; decision maybe by Christmas.
Bias? Even the article from the SFNM: “...those legislators filed an amicus brief and will get time to present their arguments against marriage equality at the hearing.”
Against marriage equality how so? A term right out of the leftist playbook. And at that it just gives the health minister a ready list when he is ordered to come for them.
