A company that fails to comply with that law is still violating the law ?

This is going to be weird. The law explicitly states that the plans must meet the standards after 31 December of this year, but it is the regulation whichndefinesmthe standards. If he waives the standards he has the authority...but he doesn’t have the authority to waive the law. If he waives the regulation...or temporarily reverts it...then anyone should be able to apply for any plan that the respective states allow.
