Even though it could be argued in a court of law that it may not be a threat of that nature, still...Get them into court and shame the ever living sh!t out of them for being stupid...

Apparently not, even if it is caught on video...
The evidence (video) could be argued that it was illegally obtained without the consent of the recorded...
At least if I was as slimy a lawyer as some may imagine...
But I did stay at a Holiday Inn Express last night...So Ah’m feeling vewy smarte!!!
All kidding aside, this will depend upon the DA, and if they choose to view the recording and decide to charge the person with making a terroristic threat...It depends on that states laws regarding such threats...
A Colorado attorney would be able to answer that better than I...
