I think there unfortunately is precedent for a law without a severability clause being allowed to stand even after a portion of it was overturned. However, I don’t know the details, and possibly it was an entirely different situation.
This whole law is probably riddled with technical flaws, since it was inserted in the shell of a perfectly innocuous, short bill sent up by Congress (requesting something like an extension of some VA or military benefit, IIRC). The earlier language of the bill, except for the preamble, was simply removed and the Dems stuffed 2000 incoherent pages of garbage into it and passed it. On Christmas Eve. Hard to believe that’s legal, but it is.
Chief Injustice Roberts will call a “Mulligan” on ObamaCare.

Last time was a slam dunk but ol Roberts changed it to a tax. I don’t trust anything that guy does at this point.
This is out there, I know, but maybe Democrats will apply pressure for a finding for the appellants, then use the severability clause as an excuse to kill the law that is killing their party. They could go back to using the lack of socialized medicine as a campaign issue.

I just saw this news over at Ace of Spades HQ. Ace thinks like you do, although he’s less optimistic. He calls it his “dream” rather than a guess.
He also says that these conscience cases are about contraception which is so cheap as to be trivial; but isn’t it also about abortion and perhaps other issues?

Obama was so much worse than I ever imagined he could be; but this law is indescribably, incalculably worse than I ever imagined.

Severability is not an issue. The contraception mandate is not in the law. It is in the regulations promulgated under the law.
Regulation can be declared unconstitutional. Then it’s back to the drawing board for the regulators.

Right. And many here on FR tried their best to spin it as ‘brilliant’ on Roberts’ part. The implication being that such a sly move somehow will result in 0care going the wa of the Smith-Corona typewriter.

My guess....Roberts will say he and his wife wouldn’t have any kids if their mother would have had birth control. But he’s sure she would have made the right “choice” and he believes all women should have a “choice”.
I think you underestimate the arrogance of men in robes.

Well, the one way to shame an arrogant person is for them to be exposed as stupid, and that’s why I think Roberts wants this thing gone .

How about we make contraceptives MANDATORY for anyone on the government teat. It would cost much less than the trillions of tax dollars taken from us to provide for the moochers. Add a huge fine for anyone making babies while on taxpayer life support.

And...It's "settled law"
I think if you read the opinion correctly, it was never ruled constitutional.
Part of it WAS in fact ruled unconstitutional, the part about the Medicaid funding.
The individual mandate part, well, the opinion basically says “Congress CAN do this if they call it a tax...”
But no where did the court acknowledge or deem that Congress HAD done it under their power to tax.
The first person who gets charged with a penalty is on the fast-track to take it back to SCOTUS!
And at that point, it WOULD be ruled unconstitutional - there’s no way around it.
the inside conspiracy theory is safe internet fodder .but it’s almost NEVER the answer.

My question as well. Since the "individual TAX (mandate)" was an integral, explicit part of the law, striking that down should have invalidated the entire law. The contraception mandate, however, seems more like an implementation decision not explicitly mentioned in the law, and can probably be struck down without invalidating the entire law (damn it!!!)

He’ll find it unconstitutional only if he’s signing onto a minority opinion. If there’s five votes to uphold without him, you can bet he will safely dissent. He’s a weasel.
Why would any conservative want anything to go to the US Communist supreme court in this day and age. It has been almost fully infiltrated by Godless forces of evil that are hostile to the USA. And Roberts is the Two Horned leader carrying the pitch fork of doom.
Cleaning out the court is far more important that cleaning out congress. The court has far more power. And that is why it was infiltrated.
I think you are misreading him on this, and the rest of the court too.
We have a good judge with Alito. Myers could have been brought up again.
A man with cute kids running around in their Buster Brown's doesn't make a good judge.
