DPS officer resigns after found to be illegal immigrant

TUCSON, AZ - An investigation has revealed an undocumented immigrant was working for over a decade as a Department of Public Safety officer in Arizona.

According to KVOA, Carmen Figueroa retained employment with DPS for 13 years possibly by using a fake birth certificate. She served as a spokesperson for the department, and more recently as an officer.

The investigation into Figueroa reportedly started when her brother applied for a U.S. visa. After Immigration and Customs Enforcement ran a background check on him, they learned his sister worked for DPS.

DPS spokesman Bart Graves told ABC15, “She resigned on Monday and has been under investigation by the U.S. State Department and DPS since late August.”

Graves added that Figueroa was placed on administrative leave at that time.

There is no word if any charges against Figueroa will be filed.

Graves told KVOA Figueroa believed she was an American citizen.

Worse. An illegal imposter was enforcing law against citizens. She should get LIFE in prison as a Spy, or shot!

Wouldn’t every arrest and conviction of hers have to be looked at and possibly nullified? If I were someone’s lawyer, that’d be my tack tomorrow.

If she was doing a good job then they should find a way to make legal.

It’s been clear to me for several years that local LE agencies are under such pressure to hire a “diverse” corps of officers that if a candidate checks the right boxes the background process seems to get....shortened. It’s far too consistent to be random.

Nullifying all those itty bitty arrests and convictions? Oh Damn! That’s got to be giving her Supervising Officer headaches and nightmares. The Defense Attorneys must be lickin their chops at all the money to be made on Litigation Boulevard!

I’d say she’s a 4 or 5. Odds are she was raised on food stamps. Just google her name for a pix.

Since when does legal status mean anything in a government position? They need to reinstate her, give her a promtion, give her a raise, and hire all her illegal relatives.

WOW — I wonder how many others are out there...if found out - and a person was arrested by them - then the charges would have to be LEGALLY dropped - since the arresting officer had no legal authority....the US Criminal Justice system is going to be hurt by this in certain locations!

The law has a widget called "defacto officer" or some such. If the assignment of the person was endorsed by some organization of government, then actions by the assignee can't be invalidated by reference to the error in making the assignment.

Same principle prevents mayhem if, for example, it is found out that Obama is not eligible under the US Constitution.

I've read a few other articles on this, and it's not entirely clear that she has committed a crime. According to a couple of other articles, her mother told her and her brother that they were born here - she may not have known that she was born in Mexico (and thus may not have known that her documents were fake).

Obviously, that may not be true. But, to charge her with a crime, you'd have to show that she knew.

This is not a new problem, its happened several times in the Border Patrol, the agent had no idea they were not born here as they lived their entire life in the US except for a week or two. Some didn't even speak Spanish.

The military has also experienced this problem.

If there was no intentional fraud involved they can be quickly naturalized and resume their duties.

You’re right. What an outrage!

This had to be intentional. Even ten years ago employers had fairly stringent verification policies.
