The bureaucracy tasked with Obamacare implementation may be violating a law that requires government agencies to keep private information safe.
Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services Center for Medicare and Medicaid Services (CMS) is required to have an Authority to Operate, or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including Security Control Assessments (SCA).
But according to CMSs 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end-to-end testing.
Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.
FISMA was enacted in 2002. Under FISMA, federal agencies are required: to develop, document, and implement an agency-wide program to provide information security for the information and information systems that support the operations and assets of the agency, including those provided or managed by another agency, contractor, or other source.(continued)

The HIPAA regulations on who has access to patient data are pretty stringent too, and have a fair amount of detail on how information systems are to be configured in order to be HIPAA-compliant. I’d bet a lot of money the ACA sites aren’t even close to being HIPAA compliant (and that’s with much of the actual information-transfer infrastructure not even in place yet).
Don't underestimate his skills either.
The only KNOWN FACT about him is he is an ID THIEF.
Everything else we have had to take his word for it. He LIES!
So a known ID THIEF want's joint access to everyone's bank account.
Why am I not surprised?
The insurance industry is largely exempted from hipaa. Its very convoluted.
Oh its much more complicated then just fisma. Theres a stack of laws andregulations about a mile high they are failing to meet.
Imagine if Nixon, Reagan or a Bush did this.
I’m not necessarily referring to the insurance industry. The haphazard construction of that site and the obviously-lax security built into it likely means that patients’ health info is accessible to people who aren’t supposed to be able to see it
“Obamacare marketplace violates federal security law”
What’s a law?
The scary part is that its not limited to just this site. The site has links to abunch of other agencies and systems. Which means the hackers were given access to those systems as well. Like the irs systems.
Exactly. The law is whatever Obama says or does. There is no body of government that will stand up to him and stop his putative dictatorship. The House has the means, but not the will.
The house is scared of itself.
Congress routinely breaks the law that declares the budgeting process. So what of it? There is no penalty, no remedy.
“....no Americans information at any level of information being held is safe”........
I am sensing this to be quite true as I have recently started getting numerous mailings about health care insurance and other issues related to health care. Where did these companies get MY name, address and health care needs?
Isn’t there a disclaimer in the law that absolves the feds of any security “glitches”? Surely the king has covered his ass and Roberts will agree.
My way of thinking is even if you have nothing to hide, the people in their government place will find out if you have anything left to rob you of.
Am reminded of Samuel Clemens where he allegedly said, "No man's life, liberty, or property is safe while the legislature is in session", or (perhaps) Samuel said something similar for there is disagreement over whether or not this was actually a quote of Mr. Clemens. My thought is ... It has come to pass that "No man's life, liberty, or property is safe while the legislature is in session". I always pray to be wrong when my brain starts to think, but I do not doubt Samuel Clemens afore mentioned words if it was actually he that said such.
