The only goal is to overwhelm the system. It’s all good.
MORE illegal tweaking, adjusting, amending, changing, and coercing.
The damnable pubbies need to stand up to this anti-Constitutional garbage.
Zero and 0bamunists are, AGAIN, making law outside of the Congress.
Sickening.
I can only imagine it will get worse if we let this abomination take root in America.
They can’t do this. IT’S THE LAW OF THE LAND. Insurance companies have to comply with ACA’s regulations.
Insures would be insane to do this for many reasons, the main one being the one you stated. They can't break the law just because Obama tells them to and he sure wouldn't cover their backs when the lawbreaking came back to bite them.
“...Officials even encouraged insurers to do something that normally would be anathema: offer coverage to consumers who sign up and pay a few days into the new year, but backdate the policies to Jan. 1....”
********************************************************************
I think I’ll go out this coming Saturday (12/14/13) to buy a megamillions lotto ticket and ask the lottery officials to backdate it so it’s effective for the drawing tomorrow on Friday the 13th.
Jackpot time baby! Hey, Obama’s setting the precedent.
Pelosi was right - They passed it and we are STILL finding out what is in it...especially since it gets re-written by everyone BUT Congress.
To hell with the rule of law.
It’s ALL going according to plan. Destroy the existing system, so that we just have to have commiecare.
Another reason is Estoppel. Even if an insurer wanted to go beyond the contractual limit of a policy, it would be very dangerous to do so. Once a limitation is waived in one circumstance, the insurer might then be estopped -- barred -- from enforcing the same limitation in a later case. But given that Obama is intentionally wrecking the system so he can completely replace it, that makes perfect sense...
Much of what the Regime wants to do is either not legal, or not possible. They are trying to shift the blame to the States and the insurers, who hopefully will follow their own interests and deny Obama’s “requests.”
Time for everyone to stock up on their Oxycontin's.
The democrats passed a law forcing insurance companies to do what they demanded. Now they’re telling them to break the law.
This is another CYA attempt by Obama to blame the evil, greedy insurers when they don’t go along with all these changes to the law.
They must really expect it to hit the fan on Jan. 1 when people who think they’ve signed up really haven’t. They also want to jack up the numbers of insured to make it look more successful.
I have never understood where the Democrats in Congress are during this fiasco. Many of them are “lifers”, and they are going to have to live with the consequences of this era long after Obama is out of office. They have acquiesced their third of governmental power, IMO.
I can’t get over the backdating thing. So, the government is “requesting” private companies to deliberately lose money. Exactly how is this different than the bus driver in Venezuela telling merchants to lower their prices to something “reasonable”*...or else.
*Reasonable, in this case, being lower than their buying costs!
Another reason is Estoppel.
I was wondering about this also...so, how many days do you get? Three? Ten? 180? A “reasonable” number?
Courts will decide. And just WAIT until someone yells “discrimination” (of ANY kind, real or imagined).
This will get real ugly, real fast, and has ramifications beyond health insurance.
“Also, the gooberment is pretty much asking the companies to commit fraud.”
Well, it would be plain and simple fraud, to the determent of their stockholders, many of whom have those stocks in the 401(k) plans...people who are saving money for future health care needs! This is just nuts...
Ok.who is going to pay for that?
So who will pay the insurers if and when the policies do not pan out after those first few days?
Will the insurers allow the Rx’s to go thru even if there is not proof of coverage?
