Actually, while I see it as a First Amendment issue, I do not see it as a speech issue as much as a religion issue and discrimination based on religion is illegal by an employer.

A&E was well aware of this family's deeply held religious beliefs and unless they had a clause in the contract forbidding interviews with other outlets, A&E is not going to come out the winner here.

It is certainly a freedom of speech issue.

It's probably more of a contract law issue. I'm sure A&E has a contact with these folks, and it'll come down to what clauses are in it (if any) which might cover the cast's outside activities.

Their right Their right its not a Constitutional issue its just an employer A&E firing an employee for expressing his religious believes on his own time in his own form.

If I were Phill I would sue the pants off A&E under their beloved “civil rights act of 1964”. Liberals should enjoy a little burning in their own totalitarian stew.

For the record when someone calls me a homophobe I just tell them im sorry I don’t share their affection for sodomy, they will have to find someone else to have ‘fun’ with.

No it isn’t. Freedom of Speech means the government can’t punish you for what you say....It doesn’t protect you from consequences from your employer.

And employers should be able to fire people at will for any reason.

It is certainly a freedom of speech issue.

Not even close. It is a free enterprise issue. And A&E can run its network any way it chooses, and the Duck family can choose whether to involve itself in a contract with that network or not. It is A&E's decision alone to make, and it is A&E that stands to reap the rewards or suffer the consequences of their decision.

No one is taking away Robertson's right to free speech or religious freedom. This is not a viewpoint discrimination case. No one is preventing Robertson from saying what he says.

If the government were forcing A&E to fire this guy, that’d be a freedom of speech issue. If they were indicting him for what he said it’d be freedom of speech issue.

This is a contract between private parties. Certainly not a freedom of speech issue.
