People filing false charges against ANYONE should have to pay the costs of the investigation AND serve MANDATORY jail time. Isn't providing false info to the police a felony in many areas?
Under the Law of Moses, a false accuser was subject to the penalty for whatever he had accused another of. Which often included the death penalty.
I think that makes perfect sense.
Good luck getting a DA to prosecute. At best you can file a civil suit AFTER you life and assets are destroyed but no lawyer will represent you pro-bono. In the unlikely chance you are victorious you will be bankrupted by legal fees.
As the recipient of such accusations, I can assure you that there was absolutely NO ADVERSE CONSEQUENCES for the ex-wife. None.
I agree- and when I refused to accept a plea deal the District Attorney threatened to charge me with Disturbing the Peace in addition- I sent my lawyer right back in and told him to go ahead.
Then I tried to file charges against her for filing a false statement against me- he initially told me he was NOT going to prosecute it, since it was just me trying to ‘get back at her’
I told him only one crime was actually committed that day, when she filed false charges against me. I explained that even though I had the charges dropped she was STILL using the arrest against me in court in our divorce, and the only way I could stop her was to prove she lied.
AND if he didn’t proecute her I would file a “writ of mandamus” to force him to do his job... He didn’t like that I knew that term and eventually prosecuted her.
But the entire system is rigged against men. The judge in the divorce STILL mentioned her FALSE charges against me, but never mentioned her PROVEN crimes.
