Roberts ruled that essential aspects of the “Affordable Care Act” constitute a tax. To have standing to challenge a tax, someone has to have suffered damage by actually being forced to pay it. The group suing hasn’t paid it, so they have no standing. Therefore, Roberts rationally denies their request for a stay.
I’ll put the conspiracy theories on hold until someone actually pays the tax, challenges it, and works a case through the court system to the SC. The sooner that happens the better, since we are one “conservative” justice away from rubber stamp approval. Waiting for all this bs sucks, but that is how the law works.
obamacare was enacted illegally IMO and it has been protected illegally....
the justices can interpret whatever they want or are demanded....
the law is an ass....because language is an ass...."is" can be anything at all.....
anyway, I'm tired of rulings being explained away because of the constitution or laws or past rulings etc as if any of that means anything...the judges rule whatever they want anyday of the week, and never answer for it.....
Staying the law while being challenged first in the DC Circuit was a hopeful move without a guaranteed positive procedural outcome.
It might have worked and one would have been a fool not to have at least tried it as AAPS did.

The other angle is standing: Someone will have to pay the tax and go through procedure. That's the way it works.
Obama loves all the talk and postings around here and at the Western Center for Journalism blog about impeaching and throwing out Roberts. He plays his opposition like a fiddle.
I am no fan of Roberts for what he did, but I am holding fire, and won't get roped.
Why don't people around here concentrate more on getting rid of Obama instead?
