City, county settle NM 'anal probe' lawsuit

ALBUQUERQUE, N.M. -- A city and county in southern New Mexico have settled a lawsuit filed by man taken to two hospitals and forced to have anal probes over suspicion of hiding drugs.

Attorney for David Eckert said Monday that Hidalgo County and the city of Deming recently settled their portion of a lawsuit for a total $1.6 million.

The lawsuit, filed against police and sheriff's officials in Deming and Hidalgo County, which borders Mexico, alleges Deming police sought a search warrant for Eckert because they thought he appeared to be clenching his buttocks when he got out of his car in January 2013.

Despite the body searches, no drugs were found.

Hidalgo County and Deming officials both declined to comment about the settlement to The Associated Press.

The lawsuit against doctors and the hospital in the case is still ongoing.

I definitely look at Nazi Germany in a different way than before — not more positive, of course, but I think I understand how it happened (at least a little more).

These settlements ought to come out of their pension funds instead of making the taxpayers cough it up.

Couldn't agree more...if these settlements hit THEM in the wallet; perhaps they would dial it down in the future.

$1.6M hardly seems like justice but the money should come from the cops, doctors and hospital that did all this and not the local taxpayers.

That's just the settlement with the city and county, the hospital and doctors part of it hasn't been settled yet.

I agree with other posters in here... the people involved need to be held personally liable for these sorts of things, not just the taxpayers who have to pay these settlements.

I’m fine with the payout. But the two cops involved should be in the slammer. Instead, I believe one of them got promoted.

It upsets me that no one lost their job, and no one went to jail for it.

What is shocking to me is HOW MANY people did cooperate and assist with the anal probe. “How could SS soldiers follow such obviously horrible orders...?” THIS IS HOW. The cops said he was a bad guy, do the anal probe, and THEY OBEYED.

I agree. We already have a huge criminal class that has proven they don't care about right and wrong. The moral underpinnings of our nation have been kicked out from under us by Hollywood and the socialists and homos who run the place. Plenty of people living on the edge will do whatever the government demands just to maintain a home.

I recently read Walter Shirer’s “The Rise and Fall of the Third Reich” it was very detailed, to me even a tab boring, but he was there on the scene and a lot of it is first person reporting.

What I took away from it was this: if you are willing to break every law, if you are willing to use violence, if you really don’t care what people will say, you can make a lot of muck.

Are we there yet? I don’t know, but cases like this one are disturbing.

We really need to get a right guy (or gal) in the WH in 2016, someone who will not be willing to let sleeping dogs lie.

We need to shake this snowglobe up.

I cannot imagine anyone giving a colonoscopy to someone without their permission. I had the police bring in a young guy to the hospital and I was the one to admit him. You could tell by the color of his hands and wrists, the cuffs were on to tight, I told the cop that he would have to lessen the cuffs and it was interfering with circulation and he was not going to handcuff him to the bed until the cuffs were loosen. Cop said....I am not going to loosen the god dam cuffs....(he was a bit hostile) I told him OK when I chart this admission, I will describe the condition of the patient and that you refused to loosen the cuffs to allow proper circulation. The cop was dumb but not stupid, he swore again and loosens the cuffs. Nurses notes are legal documents that go to court. If you even misspell a word, you have to initial it and spell the word correctly. A cop is not a medical professional and the doctor and any nurses involved are in for a big surprise when court time comes. Drugs have to be administered for a colonoscopy, it was not a one man procedure...
