I am by no means anti-death penalty, but I have an issue when the death penalty is applied for crimes that didn’t result in a murder. The issue with rapist being executed is what about when the woman lies about rape? It’s not like it hasn’t happened(Most recent example is Brian Banks who served 5 years over a lie) Would women rapist and pedophiles(and if you think they don’t exist you are wrong) also be executed or just men(thereby violating equal protection)

Which begs the question

What purpose does the death penalty serve...?

1. To exact an eye for an eye type of punishment ?
2. Rid society of vermin that don't deserve to breathe same air as us...like rapists and child molesters...

I would tend to be on your side of the argument as long as rapist and child molesters served long and hard prison terms...

I’m more in line with Texas in that respect: if you have 3 people who witnessed it, that’s grounds for summary judgement. Murder, no doubt. Rape, there needs to be some justification. For instance, was a rape kit done on the victim, and does it show the perp’s DNA? If a man and a woman are complete strangers, and a man’s pubic hair is found on a woman’s body, I think that’s pretty clear evidence of sexual assault. There’s a higher bar for rape since it’s a he said/she said thing.

I don’t disagree that rape is difficult to prosecute, but if there’s clear cut evidence of sexual assault or a history of sexual assaults by a single man/woman, why allow that person to continue raping or put them up in a cushy cell for the rest of their life?
