Homeowner kills burglar he finds in house

Jacksonville police have judged that a homeowner who shot and killed an intruder inside his house was justified in firing the shot.

But the homeowner, whose name has not been released, has been arrested for a misdemeanor violation of injunction for having a firearm, and was taken into custody Saturday afternoon, police said.

The shooting occurred around 10 a.m. at a house on the 2700 block of Aubrey Avenue. The intruder was taken to UF Health Jacksonville and pronounced dead, said Sgt. Jay Farhat with the Jacksonville Sheriff’s Office.

I would like to know exactly why the Home Owner was arrested, though.

Was he not able to legally own the weapon? Or, is there something else at work, here?

So now if the dead perp has any friends or relatives that might want revenge they can be pretty sure that the homeowner won’t have a gun to protect himself. I guess he can always call 911, right?

This is a classic example where the phrase “res ipsa loquitur” ( the thing itself speaks ) where the fact
that he was justified in using a firearm means he was
justified in possessing one. The idea that one cannot
legally have possession of a firearm yet be legal in
using one in self defense is the height of ludicrousness
and judicial hubris.

Any idea of what that means? On probation? Un-permitted possession/use due to legal conviction? PFA terms for ex’s safety?

I speculated that it might mean that he has a restraining order against him in a domestic case, or a judge placed an injunction against him owning firearms because of something from some other action, perhaps drunk driving, threats, hard to say.
