In an unanimous ruling, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit said the rules requiring tax-return preparers to pass an initial certification exam, pay annual fees, and complete at least 15 hours of continuing education courses each year went far beyond what Congress had ever authorized.
Law Blog earlier reported on the origins of the dispute, which trace back to the post-Civil War period.
To crackdown on fraudulent claims against the government for dead and missing horses and other property lost during the Civil War, Congress passed what became known as the Horse Act of 1884. It authorized the Secretary of the Treasury to regulate agents, attorneys, or other persons representing claimants before his Department. Today, that statute is codified under Section 330 of Title 31 of the United States Code.
