BAKERSFIELD, Calif. (KBAK/KBFX) — The American Civil Liberties Union is accusing Immigration and Customs Enforcement of violating its commitment to no longer conduct enforcement actions at Kern County courthouses.

"(ICE) is using information they gather from the courthouse and using that to conduct arrest and enforcement actions," said ACLU staff attorney Michael Kaufman. "That's exactly what ICE national told us they were going to stop doing."

Luciano Sandoval, 41, of Bakersfield, went to pay a traffic citation on Feb. 3. Sandoval said that three days later, he was on his way to work early in the morning. The car he was in was pulled over on Union Avenue between Fairview Road and Pacheco Road. Sandoval said ICE agents never told the driver why they stopped the vehicle, and Sandoval was the only one arrested for being in the country illegally.

Sandoval said he came to the United States from Mexico in 1992 and has never had any serious brushes with the law. His only contact with law enforcement is for traffic-related tickets.

He said his arrest by ICE is related with his recent visit to pay his traffic ticket. ICE placed an ankle bracelet on Sandoval, and he was released from custody.

In October 2013, ACLU documented cases in which ICE agents arrested people at courthouses as they attempted to pay tickets or applied for marriage licenses. ACLU claimed such arrests undermine public safety.

"This type of enforcement actions really deter people from going to the courthouse from complying with their legal obligations," said Kaufman.

In response, ICE agreed to stop such practices.

What kind of ticket can you get,so that when you show up at the courthouse to pay this ticket- that the court issues an order for ankle bracelet to be put on your person ? This story makes out like it was some small causal ticket that should not be a matter of concern. His past shows he continues to rack up ticket after ticket after ticket. In comments sections some said dui ? I did not see it lised. My take is he must be an "habitual law breaker" that keeps on breaking the same laws over and over and over. In the posted video,he claims he was arrested for driving without a license.. I assume other tickets were for the same thing. No license/insurance. He is back driving 3 days later after paying ticket..

No. People pay tickets all the time and aren’t deported. Being an illegal alien landed this man in deportation proceedings.

“violating its commitment to no longer conduct enforcement actions at Kern County”

Don’t you just love the little pockets of ideology that refuses to enforce our laws and get away with it.

Now you try that.

ACLU complaining that ICE is actually doing their job, despite Holder’s directive on which laws should or should not be enforced. Next up: ACLU complaining that a felon was not allowed to vote when Holder said they can now.

Has CA started issuing driver’s licenses to illegals?

The immigration laws currently on the books are “the law of the land” AND SHOULD BE ENFORCED! If we aren’t going to enforce these laws, we should not enforce ANY laws.

California on Thursday (October 3, 2013) joined the growing list of states that allow immigrants who are in the U.S. illegally to obtain driver's licenses -- a measure supported not only by Latino activists but by police chiefs and insurance authorities.

Democratic Gov. Jerry Brown signed the bill in front of a cheering crowd of immigrants and their supporters, predicting other parts of the country will follow the example set by the nation's most populous state.

The licenses, which are expected to become available no later than January 2015, will carry a special designation on the front and a notice stating that the document is not official federal identification and cannot be used to prove eligibility for employment or public benefits.

Sounds like he was driving illegally.

A pejorative to a bad driver used to be, “Where’d you get yer’ driver’s license, out of Cracker Jack box?!”

Now, they needn’t even buy the Cracker Jacks! Licenses are handed out like party favors!

He says he was on his way to work.Ice he is in country illegally. This going to work without the right legal documents could suggest he was using fraudulent documents to be working in the first place.Ice should go where he is working asking how many other illegals on payroll ?

Did paying traffic ticket land man in deportation proceedings?

I should certainly hope so.
