The Federal Communications Commission said Wednesday it would again issue rules to prevent Internet service providers from blocking or slowing down access to content providers that don't pay a toll to reach consumers.

Last month, the U.S. Court of Appeals for the District of Columbia Circuit threw out FCC rules barring providers from blocking or slowing down websites, but it acknowledged the FCC has some authority to regulate broadband-company practices under a section of the 1996 Telecommunications Act that gives it broad authority to encourage U.S. broadband service.
The FCC said Wednesday it won't appeal the D.C. Circuit's ruling. Instead, it plans to take advantage of Section 706, of the law to propose new rules in the late spring or early summer, after soliciting public comment.

Then Netflix came along and ruined it. Companies lose money when Netflix users have unlimited data plans. So Verizon wanted to charge a different price for Netflix users, rather than increase rates for all. They won their lawsuit, but it doesn't matter now, because they are getting rid of their unlimited data plans. You can keep your grandfathered in unlimited data plan as long as you don't get a new phone.
Classifying it as a utility was what the Dems wanted. The reclassification would subject the industry to regulations similar to land line phones and would be the death of the broadband market.

The court said in January that the FCC could impose a “no blocking” rule if it found a different legal justification. Mr. Wheeler’s statement indicates the FCC will do just that, by establishing a minimum standard for how broadband companies treat content. The rules would likely outline expectations and unacceptable practices for broadband providers, and provide for case-by-case enforcement when websites complain of unfair discrimination.

Shep covered this issue nicely last night: one group of big companies fighting another group of big companies: namely the content providers vs the net backbone providers.
He said a third of all the net traffic comes from streaming movies from outfits like netflix. But netflix is objecting to having to pay for this, so netflix et. al. want to keep all the gravy but have someone else pay the freight.
So called net neutrality comes down on the side of netflix, HBO, etc. and screws the net carriers. Basically, it’s just another fascist intervention by the Obammunists, giving special dispensation to favored corporations.
Curious that he WSJ has pulled all stories relating to this matter.
