‘The Imperial Presidency’ [constitutional law experts testify before House Judiciary Committee]

Constitutional law experts... warning... of an “imperial presidency.”

The hearing, “Enforcing the President’s Constitutional Duty to Faithfully Execute the Laws,” focused on the multiple areas President Barack Obama has bypassed Congress, ranging from healthcare and immigration to marriage and welfare rules.

Jonathan Turley, Shapiro Professor of Public Interest Law at George Washington University, testified that the expansion of executive power is happening so fast that America is at a “constitutional tipping point.”

“My view [is] that the president, has in fact, exceeded his authority in a way that is creating a destabilizing influence in a three branch system,” he said. “I want to emphasize, of course, this problem didn’t begin with President Obama, I was critical of his predecessor President Bush as well, but the rate at which executive power has been concentrated in our system is accelerating. And frankly, I am very alarmed by the implications of that aggregation of power.”

“What also alarms me, however, is that the two other branches appear not just simply passive, but inert in the face of this concentration of authority,” Turley said.

While Turley agrees with many of Obama’s policy positions, he steadfastly opposes the method he goes about enforcing them.

“The fact that I happen to think the president is right on many of these policies does not alter the fact that I believe the means he is doing [it] is wrong, and that this can be a dangerous change in our system,” he said. “And our system is changing in a very fundamental way. And it’s changing without a whimper of regret or opposition.”

Elizabeth Price Foley, a law professor at Florida International University College of Law, agreed, warning that Congress is in danger of becoming “superfluous.”

Beware of dog-and-pony shows by corrupt Congress concerning the Constitution. Congress is just as guilty as Obama with respect to wrongly ignoring the federal government's constitutionally limited powers.

In fact, here's a Supreme Court “license” for voters to simply apply their reading skills to interpret the Constitution.

"3. The Constitution was written to be understood by the voters; its words and phrases were used in their normal and ordinary as distinguished from technical meaning; where the intention is clear, there is no room for construction and no excuse for interpolation or addition." --United States v. Sprague, 1931.

Up against the media which dictates public opinion as well as their own temptations toward comfort, sloth.and wealth (bribery), and they don’t know their jobs. They are unacquainted with the constitution they are sworn to defend. They’d rather go on night talk shows, imus and the Sunday shows, schmooze and then spend their efforts attacking anyone of their own (Cruz) who dare do their jobs

They are enablers

The Framers knew exactly what would happen if the states left the senate. The wonder is that it has taken so long for an Obama to appear.

Blackmail works well with SCOTUS and the congress has no backbone.

Not only won't they stand up against King Obama to protect their own Constitutional powers.

They stand idly by while he demonizes and threatens innocent citizens who do not support him.

Then they quietly watch as he misuses the oppressive power of our own government to discriminate against us and punish us for ebing patriotic and believing in the law and the constitution..

The authors of the Constitution did not realize the voters would be so dense that for over 180 years they would not realize that the Constitution guaranteed a mother the right to kill her child, and even longer to realize that the Constitution places same-sex unions on the same level as traditional opposite-sex marriages.

James Madison lived for more than 40 years after the Constitution was ratified. You'd think that sometime during those years he would have taken the trouble to point out to people how obtuse they were in their reading of the Constitution.

Mr Turley said a mouthful with this statement.

It is exactly why I have been railing against the members of Congress and their DERELICTION OF DUTY. They have done NOTHING AT ALL to honor the Oath of Office that requires them to “PRESERVE and PROTECT the Constitution of the United States.

As a result, I do not see where a vast majority of Congress deserves anything short of being run out of office and forever held in complete disdain and contempt.

I think it is time for possible Republican presidential candidates to list out their executive orders and lists of laws they will disregard. I would start with BATF stamping approve on all requests sent in and no more audits. Leaving the office will no longer be required. Then, recommend that ICE and IRS pair up and audit every single illegal that is caught.
