Ky. seeks delay in recognizing same-sex marriage

LOUISVILLE, Ky. — Kentucky’s attorney general has asked a federal judge to delay by 90 days an order requiring the state to recognize same-sex marriages performed in other states and countries.

The two-page filing Thursday morning says the delay is sought to give the attorney general time to decide whether to appeal the Feb. 12 ruling and would give the state an opportunity to prepare to implement the order.

As mentioned in related threads, the states have never amended the Constitution to expressly protect so-called gay rights, an argument that I am not hearing from institutionally-indoctrinated state attornies who are trying to fight pro-gay judicial activism. So the states are free to make laws which discriminate on the basis of gay issues, imo, as long as such laws don't also unreasonably abridge constitutionally enumerated rights.

Also note that, regardless of media distortions of the Supreme Court's decision concerning the Defense of Marriage Act (DOMA), Section 2 of DOMA is evidently still in effect. Section 2 is actually a bona-fide example of Congress's constitutional Article IV, Section 1 power to decide the effect of acts and records of one state in the other states.

Section 2. Powers reserved to the states

No State, territory, or possession of the United States, or Indian tribe, shall be required to give effect to any public act, record, or judicial proceeding of any other State, territory, possession, or tribe respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State, territory, possession, or tribe, or a right or claim arising from such relationship.

Section 2 of DOMA is further evidence that the activist judge who decided against Kentucky's gay marriage ban is abusing judicial powers imo.

I think that patriots need to work with their federal lawmakers to require federal judges to reference specific constitutional clauses in their official decisions to substantiate their decisions. In other words, no more PC decisions expressed by activist justices merely as "constitutional" and "unconstitutional."
