M.D. Harmon: Obama cultivating a fourth branch of government

Federal agencies that spurn congressional authority are becoming an independent branch.

I’ve finally come to see that it’s Barack Obama’s country, and we all just live in it.

The Founders intended that the three branches of government have respect for each other’s roles. But while those boundaries once appeared to be inscribed in granite, they were really written on the wind.

It turns out the Founders’ ideal was entirely dependent on the willingness of the leaders we elected to honor it.

Thus, those boundaries were far more fragile than they appeared. They have been weakening for decades under progressive legal theories, and all it took was the election of a president with absolutely no regard for them to send them finally toppling.

...

law professor Jonathan Turley, a liberal Obama voter who nevertheless told the House Judiciary Committee on Dec. 3 that the structure of the U.S. government was becoming something the Founders wouldn’t recognize.

“I really have great trepidation over where we are heading because we are creating a new system here,” he said.

The Constitution forbids the president to usurp the powers of Congress, he said, adding that federal agencies under Obama’s direction that spurn congressional authority are becoming an independent branch of government.

“We have this rising fourth branch in a system that’s tripartite,” he said. “The center of gravity is shifting, and that makes it unstable. And within that system you have the rise of an uber-presidency.”

Turley continued: “There could be no greater danger for individual liberty, and I really think that the framers would be horrified by that shift because everything they’ve dedicated themselves to was creating this orbital balance, and we’ve lost it.”

But Obama’s core supporters don’t care, says historian Victor Davis Hanson.

Regulatory agencies for years have been morphing into a 4th branch of gov’t. Under Obama, they are getting assistance, support and money.

There’s a certain German Leader who proved that a government doesn’t actually have to ‘own’ the means of production, just tax and regulate business to comply with the desires of the government.
Along with regulatory agencies, we have GSE’s in Financial, Health Care and Energy Industries who’s rules are being made up on the fly.
Show me a man and I’ll show you a crime so they say.

Not exactly. It was entirely dependent on us paying attention, seeking truth and having the guts to stand up and defend this precious gift we were given.

We failed miserably and got the leaders we deserved.

Federal agencies that spurn congressional authority are becoming an independent branch.

This is an excellent point.

I would say, rather, like the synod, they have been religiously supporting islamic cells and friendly private cults.

Indeed, they are a theocratic cult.

Congress created the Consumer Financial Protection Bureau (CFPB) and made it a self-funding part of the Federal Reserve.

Like the NSA, when an agency gets all the money it can justify, the scope of its powers and regulations grows until it starts doing outrageous things, and even then it is difficult to restore restraint. It may take a few years, but it is only a matter of time before the CFPB starts to over-intrude and over-regulate.

Already, they have demanded detailed access to all credit card transactions in the US.

Since the Federal Reserve is a private corporation, this raises an interesting Constitutional issue: to what extent can Congress delegate the power to make regulations having the weight of law to a private corporation owned only by the “member financial institutions?”

It turns out the Founders’ ideal was entirely dependent on the willingness of the leaders we elected to honor it.

Not true. To secure freedom, our Framers' design relied on vertical separation of power, federalism in a senate of the states. After 101 years, instead of protecting the prerogatives of the states as per the 10th Amendment, the senate has become a rubber stamp for a demagogic president.

We just need to fill our voting booths with liberty-loving Americans. And keep on filling them.

Semiannual elections are increasingly for show, to condone the illegitimate powers of the uniparty. Elections alone cannot reverse our dive into despotism. Obama has accumulated powers that no election can reverse.
