(Florida) Senate Panel Backs Bipartisan Tweak To ‘Stand Your Ground’

TALLAHASSEE (CBSMiami/NSF) – A bipartisan bill that would tweak the controversial “stand your ground” self-defense law sailed through the Senate Criminal Justice Committee on Monday, passing unanimously with the backing of both the National Rifle Association and Democratic Congresswoman Corrine Brown.

The measure (SB 130) by Sen. David Simmons, R-Altamonte Springs, would make several changes recommended in 2012 by Gov. Rick Scott’s Task Force on Citizen Safety and Protection, which Scott appointed amid a national uproar that followed the shooting death of teen Trayvon Martin.

From the article:

“You cannot fix everything the first time,” (NRA lobbyist Marion) Hammer said. “When you try to do too much is when you create problems. We’re taking it one step at a time. … And if we didn’t get it right, we’ll fix it. But we’re comfortable with what we have today.”

Sounds like incrementalism - and it's coming frmo the mouth of the NRA.

As I have stated before, the true goal of the Zimmerman Trial was to get both the Florida Stand Your Ground Law and the Castle Doctrine struck down, giving the Leftists court precedent to get similar laws in other states stricken from the books.

The end result? Citizens (that means you and me, for those in Rio Linda) would not be able to defend ourselves when the Gibsmedats come boiling out of the urban kraals.

If they can't ban it outright, they'll legislate it into oblivion.

Problem is that the Zimmerman case is a classic example of what stand your ground protects, even though it doesn’t really apply.

That is, Zimmerman was getting the crap beat out of him. If you can’t use deadly force then, when can you? And what does that make you?

It also would no longer preclude lawsuits from third parties who are injured by negligent conduct used in self-defense.

This is a problem. Third parties who are injured by negligent conduct? What is a third party, the getaway driver? What is negligence, 10 shots instead of 6? This opens the door for frivolous prosecution or costly civil defense of the defending citizen.

Brown brought her congressional colleague, U.S. Rep. Bobby Scott, D-Virginia, who told lawmakers that homicide has gone up in states with “stand your ground” laws.

Homicide has gone up? That's total BS unless you are including all justifiable homicide, beatings, strangulation, drunk driving, etc. Even then, I struggle to believe that "homicide has gone up in states with “stand your ground” laws." I'd like to see some proof of that stat.

Something very similar just happened just north of Milwaukee. A maintenance guy was beaten with a baseball bat by three perps, two were holding while one beat him. He drew his CCW and killed two of them. He is currently IN JAIL (illegally according to WI Castle Doctrine Law) pending a court decision. Hope he beats that rap.

It depends what the tweak is. We cannot assume the law is written perfectly. Politician write bills, and there is room for error.

As a citizen I don’t want someone to shoot me and then twist the situation to somehow show they feel they were threatened. I am a firm believer in Stand Your Ground, and I am not saying that is what the law says, but unless I have an understanding that the law has been altered to damage it’s core purpose, I withhold judgement here. The left is completely wrong in their Trayvon movement, but that does not mean the law is without room for improvement.

If Brown is for it the [tweaking ,reform, emasculation or what other term you choose], then I am against it. And so should every law abiding Floridain. That is, if you value your life and the lives of family members.

If a Miami newspaper is for it then the changes are bad.

Agreed.

Any new law, or change to an existing law, proposed or supported by Leftists is automatically bad for us all.

When they are finished “fixing” it , it will require law abiding citizens to: 1. Open the doors to their homes and assist the burglar in the removal of your property. And thank them for relieving you of the burden of property ownership. 2. Accompany the robber to the bank to ATM machine and withdraw your savings and place them neatly in the purse or wallet of the robber. And thank them for allowing you to assist with their purchase of crack along with apologizing because did not have more to contribute. 3. Accompany the rapist to the bedroom with your wife and daughter[s] if you have any, undress her and lay her on the bed for him. If you have no daughters, apologize profusely for only having a wife for him to rape. 4. Ask the players of the knockout game what position.

I could go on , but the point is that we, the law abiding, who only wish to live our lives in peace are about to get royally For Unlawful Carnal Knowledged.

That was how the media and their minions,[ a good number of them happen to be on this forum] spun [told and retold] it until fantasy became reality. They begin with lies, they ended with lies.

“The bill would clarify that a law enforcement agency must fully investigate whether a person claiming self-defense has lawfully used force. It also would no longer preclude lawsuits from third parties who are injured by negligent conduct used in self-defense.”

Effectively gutting it. Martin jumped Zimmerman. Zimmerman fought back and killed him. Case closed.

They are pandering to a black racist liar - Al Sharpton. Pandering will just encourage more demands and bad behavior from him and his thugs.

What will become of society once the people who are civil — are required to flee from those who have devolved into barbarians?
