Property boundaries, of course, must be respected, and trespassing across them becomes a legitimate matter of governments concern. So, too, if you build a huge bonfire that rains toxic ash onto your neighbors land. Or hurl water balloons at his house using a giant, rubber-tubing slingshot that requires three people to operate.
And as old as the law itself are rules governing the use of water from flowing streams and rivers to ensure that landowners downstream are not denied their right to have and use water for their own benefit. These laws have never been designed to deny anyone the use of flowing water, but rather to ensure that everyone owning land along the waterway is able to enjoy reasonable use of the water.
But never in the history of Western thought or English common law have reasonable men been confronted by the Environmental Protection Agency.

But what the EPA fails to list is exactly how many gallons of completely untreated wastewater the agencys 5,000 employees flush directly into the Potomac River every year.
That is because whenever it rains in your Federal City, the sewage treatment plant cannot handle the flood of storm runoff and sewage at the same time. So it just dumps a couple of billion gallons of completely untreated sewage into the Anacostia and Potomac rivers, which flow into the celebrated Chesapeake Bay.

Absolutely! It would save taxpayers billions and fiascos such as this and other incidents like this yearly.
Article would have been much better had he bothered to detail why the EPA claimed their pond was illegal, and then demonstrated why it was not.
Bloviating about how much sewage goes into the Bay from DC is about as irrelevant as anything I can imagine.
This nation would not be where it is if it were not for private industry using private funds to build dams for mill ponds and reservoirs used to fill steam locomotive tenders.
Obstruction is the game.
The property I am looking to buy has a large stream running through it... I am considering building some sort of low key paddlewheel generator for my own low capacity hydropower to keep a 12 battery system charged... I expect that if I ever do so, someone will show up unannounced attempting to apply a boot to my neck.

Navigable waterways?
I understand from other articles I’ve read this stream is not navigable but the EPA has control even over streams.
Louisville Slugger through the halls of EPA would solve some of this nonsense.
Just massive criminality from the Marxist thugs of the EPA.
I found out that I had to pay $3000 for the permit application, and wait up to 3 years, and also had to have engineers studies submitted at an additional cost of $10k or more.
I built the pond, and waited. About six months later, a disagreeable neighbor (who I had taken to court in a civil trespass and won) reported my pond. I got a visit from the WV DNR and had to pay a $5000 fine.
It's a nice pond,, but I ended up selling the lot... and now live in (almost) Paradise (Davao City, Philippines)!
The guy in this fiasco in Wyoming actually got the permits and the okay from the state for his pond but then the EPA came in later and dictates to him that it has to be taken out.
The EPA did not detail what was wrong but claimed it was illegal even though he had state permits. EPA pissing on citizens because they can and will run you through the administrative processes which they control all the while keeping it out of court where they could lose. When it gets to court, in these type cases, the EPA almost always loses.
Yes, he should have been more specific about the sewage coming out of DC ... out of Congress and the White House and is no irrelevant.
