Here’s how Issa will unwittingly sabotage himself. He’s good on the front end but bad on the follow through. There’s no saliency to Issa wondering about this: It leads nowhere. He needs to stick to the center cut of the steak and not worry about the edges.
In addition to being very serious in terms of the implications, this is an issue that touches everyone provided Republicans can make the case. Because for example, while everyone wants to “help the poor”, nobody likes paying taxes and the very idea that the IRS is really the Internal Retribution Service can really get some legs in this era of relentlessly rising taxes.
Yeah, Benghazi is also a big deal but it’s only four people and half a world away. And there ain’t no evidence. With this IRS thing, there is massive evidence and I really hope Issa doesn’t foul it up.

This is a Congressional hearing, not a ‘criminal case’.
‘Person’, as stated by the amendment would seem to imply a private citizen living under its terms. NOT an officer of the government acting under color of law. The amendment even describes the routine of denying this privilege to the military. Ms. Lerner is merely an employee. Any actions taken in the course of her office do not have the privilege of the Fifth.
If Issa decides to grill Cummings he don’t get the fifth either.
