G.M. Seeks to Fend Off Lawsuits Over Switch

General Motors moved on Tuesday to prevent future safety lapses by expanding its oversight of problematic vehicles even as the automaker continued to take an aggressive legal posture in dealing with its past missteps.

General Motors has asked a federal bankruptcy judge to dismiss dozens of potentially costly lawsuits filed against the company over its handling of a defective ignition switch in millions of cars, and to bar similar cases in the future.

But the move carried risks, too. A coalition of eight of class-action plaintiffs countered with a lawsuit in the same bankruptcy court seeking to void that part of the restructuring agreement and accusing G.M. of committing bankruptcy fraud by not disclosing potential liabilities from the faulty switch. G.M. has acknowledged that it knew about problems with the switch internally for more than a decade before it recalled 2.6 million vehicles this year.

“It appears that old G.M. intentionally and fraudulently concealed the defective ignition switch from the bankruptcy court and parties in interest,” the suit said.

They don’t want to spend union legacy cost slush funds they’ve netted on a bunch of racist car crash victims and their families. Got to have priorities - just like the racist GM bond holders found out..

Actually, doesn't this make the US Treasury's sale of GM Stock last year seem somewhat like "Insider Trading"? Can the Government's SEC sue the Government's Treasury?

G.M. has killed more people than Toyota supposedly killed and Toyota has to pay over a Billion to settle their case??

Bankruptcy code is clear. If you KNOW there is a creditor or potential issue and you conceal that fact in your bankruptcy, then you do not get out of it.

The only way to include them is to REOPEN the bankruptcy case.

If this was any other debtor, this would not even be at issue. GM would be screwed.
