With any luck she'll decide the pressures of the court are too much for her health and she'll retire to spend more time with her family.

I hate the thought of the decades ahead with this utter joke of a maoist supreme court justice deciding how we should live our lives.

Her agenda/ideology trumps the law.
Being affirmative action herself, she probably wasn’t even trained well in the law or expected to be trained well.

The whole point, to her and most leftists, of getting a law degree and becoming a judge is to force the leftist agenda on people DESPITE the law.

I would agree with you if Hillary or another Democrat is elected president in 2016. The next president is going to tip the balance of the federal courts, including the Supreme Court. If that president is a Democrat, and considering how radical types have taken over the Democrat party, then 8 years of Hillary on top of 8 years of Obama will drive the federal courts into solid liberal territory for generations.

I ask anyone that spouts that “living constitution” garbage whether they’d sign on to a “living contract” with any workman, with the understanding that he can change the terms and definitions on a whim to suit his present inclinations.

she has a civil law court vs a common law court world view.

In Europe judge can literally write law from thin air and not just limit to interpret law.

She was unqualified to be a judge at any level and it is being proven every day.

Also interesting that the same liberals who are trashing Thomas for his vote have nothing to say about Breyer’s. Can’t speak ill about a member of the club, I guess.

Minority students who move up the ladder of education on the shirttails of Affirmative Action run the risk of catastrophic failure. Catastrophic in that having flunked out of Yale, dropping down to Podunk Community College is worse than dropping out of education completely. States that do away with strategic racism are doing everyone a favor.

Let people start where they are competent to start, and reward their successes. That’s how people learn.

No, the Statists on the court knew that the Obama administration was set to take executive action that establish the executive branch as the arbiter and head of all social justice. That is probably why their were so many differing opinions on why the ban should stand.

The whole argument that the US Constitution being a “living constitution” is historically ignorant. Englishmen in the 18th Century — both at home and in the colonies — often spoke and wrote about the English Constitution. It’s true that the English had the Magna Carta, but the English Constitution to which they referred was largely unwritten and much more expansive than what King John agreed to at Runnymede. The English Constitution was, in fact, living, and empowered His Majesty’s Government to usurp what Americans believed to be their natural rights as well as the rights of Englishmen guaranteed by the English Constitution. The Founders believed that they had just cause to rebel for just that reason. It is no mere accident of history that the Americans wanted the fixity that only a written Constitution could offer.

The US Constitution was a great experiment in limited government. Unfortunately, it has failed, and every limitation on the scope of government in its text is in fact a dead letter. The real US constitution (lower case “c”) is a living constitution, and every growth you see is a cancer.

You are correct about the living constitution. Ironically any research study on literature MUST be done through historical context. Taught in every lit 1 class in the US. Not applicable to the US Constitution or the Bible.
