Arkansas judge rules voter ID law unconstitutional

(Reuters--LITTLE ROCK, Arkansas--An Arkansas judge ruled unconstitutional for the second time in about a week a new law requiring voters to show a photo ID, but said on Friday there was not enough time to prevent officials from applying the law at primary elections this month.

Pulaski County Circuit Court Judge Tim Fox said he was staying his order because to do otherwise would create "turmoil" in thousands of precincts. Last week, he said the law was "void and unenforceable."

Nearly three dozen U.S. states have voter identification measures, according to the National Conference of State Legislatures.

Many Republicans have maintained that the laws are aimed at preventing voter fraud, but several Democrats dismiss the claim, saying no such problem exists and the measures are actually a way of trying to prevent low-income people and minorities, who typically vote for the Democrats, from casting ballots.

So this judge believes the framers of the constitution would not want to make sure that only US citizens voted. BS.

In 2008 the Supreme Court ruled that states can require voters to produce photo identification without violating their constitutional rights, validating Republican-inspired voter ID laws.

In a splintered 6-3 ruling, the court upheld Indiana’s strict photo ID requirement, which Democrats and civil rights groups said would deter poor, older and minority voters from casting ballots. Its backers said it was needed to prevent fraud.

The law “is amply justified by the valid interest in protecting ‘the integrity and reliability of the electoral process,’” Justice John Paul Stevens said in an opinion that was joined by Chief Justice John Roberts and Anthony Kennedy. Stevens was a dissenter in Bush v. Gore in 2000.

Justices Samuel Alito, Antonin Scalia and Clarence Thomas also agreed with the outcome, but wrote separately.

Justices Stephen Breyer, Ruth Bader Ginsburg and David Souter dissented, just as they did in 2000.

You need a photo ID for a pistol permit. Seems like it should be unconstitiutional too, using their logic.

My question is, how do low income people get food stamps or other types of aid. Can I get food stamps? My name is Barack Obama. Yes, I am a 62 year old blond woman. Really it is me. Sorry, no ID.

None of the above. According to Wikipedia “Timothy Davis Fox is the elected Circuit Judge of the Sixth Division of the Sixth Judicial Circuit of the State of Arkansas.”

Around here, you can’t even sell scrap metal or aluminum cans without a valid photo ID

I bought some of that canned compressed air, you know to clean out your computer keyboard or whatever.....yes, I had to show ID to prove I was over 18

It’s ok to require ID for primaries, but the general elections? Oh no! Dims can’t win without an overwhelming margin of fraud!

I hope to live to see the day when a Governor politely tells a federal or state judge “NO” on one of these arbitrary unconstitutional rulings, the state legislature backs the Governor, and the people of the state strongly back their elected representatives. It is the only way the despotism of the black robed tyrants can be stopped.

Please, PLEASE do not get the impression that minorities do not know how or can’t afford valid identification. This myth hasn’t been proven anywhere, and is never presented in court scientifically. This is the official ‘excuse’ not to have voter ID.

Do not blame the minorities for this, as I always suspect those in minority area are prime victims of vote fraud, or should I say, it commonly take place in those area. Since everyone assume they all vote democrat anyway,. why bother counting or even having good poll workers there.

States should simply these ruling and force an ID check anyway, stating before hand that:

“...ID’s of all persons voting will be checked as part of an ongoing investigation in vote-fraud across the state..”

See how easy that is? You see, if there were say - money or state tax fraud going on, there’d be no hesitation to walk into a place, and ask everyone for ID.

So why can’t it be done on election day?

The problem is not the judge’s ruling; it’s that we give that ruling any respect whatsoever.

so gestapo oficers can demand id anytime, but we can’t demand voters to confirm they are who they claim to be to help keep voter integrity and ensure the vote is legitimate.

Every ID law is going to be struck down so the Democrats have a chance in the midterms.
