FULL TITLE: Will the infamous 9th US Circuit Court of Appeals make First Amendment exception for Islamists by forcing Google to remove Muhammad movie?

By a 2-1 vote, a panel of the 9th U.S. Circuit Court of Appeals ordered Google on February 26, 2014 to remove the controversial movie “Innocence of Muslims” from Youtube.com. This movie that sparked protests across the Muslim world “depicts Muhammad as a feckless philanderer who approved of child sexual abuse, among other overtly insulting claims that have caused outrage. In a 13 minute 51 second trailer, the Islamic prophet is made to look like a murderer and adulterer as well” according to TheBlaze.com

Cindy Lee Garcia filed a law suit against Google on October 17, 2012 seeking a restraining order that would require Youtube.com to remove “Innocence of Muslims” from their web service. Garcia claimed that she had a copyright for a five second video that was incorporated into the film and that she had not given permission for its use in the movie. She also claimed that she would suffer irreparable harm if the movie were not removed from access on the World Wide Web.

--SNIP--

Now the full 9th US Circuit Court of Appeals will reconsider the appeal from the district court as well as their panel's troubled ruling. They need to know that Americans treasure their First Amendment and do not want special exceptions for Islamists.

What they are in effect decreeing is: "Take it down before we have more trouble with the religion of peace."

In a sense, as long as we continue to take such a stance then the Muslims are accomplishing what they've set out to do and we're allowing it.

This sounds more like a copyright issue than a First Amendment one.She seems to be claiming that working belonging to her is included in it and that she didn't consent to its use.If I'm reading this correctly it's nothing new with youtube. Many, many videos that I've bookmarked have disappeared shortly after with the announcement “this video has been deleted due to a copyright claim by...”

Placing a figure of the prophet Mohammed in a jar of urine, calling it, “Piss Prophet”, should be okay with the 9th circus.

If it’s good enough for Jesus it’s good enough for Mohammed.

A little off direct topic, but when will the Media point out that Muslims do not have to register for health insurance? Insurance is considered a form of gambling and prohibited in Islam. So it would seem that we will be supporting all Muslims who do not sign up and they won’t be paying any ‘fee’ at all.

And that is also why medical sharing organizations are exempt. We can participate in these as an option to participating in obamacare.

She also claimed that she would suffer irreparable harm if the movie were not removed from access on the World Wide Web.

It is hard to argue with her on this point. The radical islamists supposedly killed our AMBASSADOR because of this video. Is there any doubt they would actually kill what they consider an inferior woman if they though she was part of this movie?

On a more prosaic note -- wouldn't each of us want the right to stop the publication of a video we didn't agree with if they stole a snippet of one of our videos and used it without permission?

Why doesn't the author of the video simply edit out the 5 seconds? Other than that the government threw him in jail and forbid him to touch a computer?
