DC gun carry rights case blocked in court (Emily Miller now at MyFoxDC.com)

WASHINGTON - Washington, D.C. is the only place in the country where no one is allowed to legally carry a gun outside the home. District residents are trying to challenge the law in court, but the justice system has denied them due process. The almost five-year delay in Palmer v. District of Columbia is so extreme that some suspect political games.

In Oct. 2009, Tom Palmer and three other D.C. residents filed a lawsuit in U.S. District Court that said the total ban on carrying firearms -- open or concealed -- violated their Second Amendment rights. Alan Gura is the attorney for the Palmer case.

On Tuesday, Gura filed a second writ of mandamus with the U.S. Court of Appeals asking it to force the lower court to issue a decision. He will not speculate on the reason for the long wait, but says this is not normal.

The court can’t rule the RKBA is an individual right then leave undone the right to bear arms.

If the US Constitution applies anywhere it most certainly applies in DC or any other area the US Government determines it to its territory.

It is completely normal for liberals to trample the rights of decent people . . . in their own words "by any means necessary".

While the above statement is true, it doesn't tell the story. Carry is not legal for common residents of New Jersey, Maryland, Rhode Island and the populated parts of New York. California and Hawaii are still up in the air after the Peruta case.

Since the Supreme court refused to hear Drake, they aren't going to hear this one. Drake was a better case and 19 states even asked the supremes to hear it and they didn't.

All of the states you list are enforcing Unconstitutional gun laws. “The right to KEEP and BEAR arms”. What else does that mean except to carry on one’s person?

And the nonsensical argument that it is not an individual right is off the charts wrong also, as every other right in the Bill of Rights is an individual right. Why would this one be a group right?

This case should be settled with this post.
