The requirement for it to be chambered in .40 caliber limits the choices.
Odds are the contract will go to Europe.
Something like the German built Heckler & Koch UMP40 or MP5/40 is most likely.
It is almost like the specs were written to fit the H&K.
Er, no, ARs in pistol calibers including 40 SW are available. I would bet that the intent is such a weapon-the ubiquitous A3/M4 AR pistol caliber carbine meets all of these requirements. Look at the Rock River 40.

Is the 10mm a popular caliber over in Europe still? Shoulder a 10mm chamber back an 1/8" and you have a .40, I fire .40 out of my 10mm no problem but have to clean it well before I feed 10's again.
No comparison between those two either, with a stock to help with recoil I would take a 10mm any day of the week. Too bad ammo isn't that popular or cheap here, it does have some zing to it.
